… in the premises of the contracting authority. The implementation of the project will be carried out in the following stages: a) Stage I: preliminary activities (verification of the state of energy use in buildings); Stage II: elaboration of necessary project documentation for the implementation of savings measures, implementation of basic energy-saving measures (see in particular Part Three of the contract), including elaboration of documentation of actual implementation of savings measures and elaboration of operating rules for newly installed equipment and operator training; Stage III: the provision of energy management and guarantees, including, in particular, the annual preparation of a report on the savings achieved, the provision of energy management, continuous evaluation of savings and the provision of a guarantee for the achievement of contractually guaranteed savings, the proposal and, after the consent of the contracting authority, the implementation of additional energy-saving measures, including the implementation and financial settlement of additional measures. The contract will be implemented using the Energy Performance Contracting (EPC) method. This is a comprehensive public contract involving the preparation, implementation and subsequent long-term monitoring and evaluation of the results of the implemented energy-saving measures, whereby the contractor provides the contracting authority with a guarantee for achieving the expected economic benefits. Concrete energy-saving measures will be proposed by the supplier himself and included in the EPC project, which will then be implemented in selected buildings. The proposed energy-saving measures will include, according to the contracting authority's assumptions, the area of heating, building measures improving the thermal and technical properties of buildings, lighting, consumption of hot or cold water, etc. The content of the preparatory work is a complete design and engineering activity for obtaining a building permit (if necessary) and the subsequent delivery, installation and commissioning of the energy-saving measures (with the submission of documentation for the building permit and documentation of the actual construction). Savings will be contractually guaranteed, continuously monitored, evaluated and documented by the supplier. The contracting authority envisages the co-financing of the subject-matter of the public contract under the 102nd call of the Ministry of the Environment under the Operational Programme Environment (hereinafter also referred to as the ‘Environmental Programme’). The contractor bears the relevant risk of failure in achieving savings through the implementation of the measures proposed and implemented by the contractor, including the risk of reducing the possible subsidy from the OP Environment due to the project parameters guaranteed and not fulfilled by the contractor. The contracting authority does not expect the equipment in question to be rented by the selected supplier or to be operated. The subject of the tender is also not the procurement of energy by the supplier or the sale of thermal energy to the contracting authority. The annexes to this tender specifications contain a more detailed specification of the objects which are the place of performance of the public contract. The contracting authority states that further details regarding the conditions of performance of the contract may be further discussed with qualified participants who submit preliminary tenders at the next stage of the procurement procedure, and the contracting authority will be entitled to do so in accordance with the provisions of the Act. Section 61(10) of the Act also lays down other binding terms and conditions during the negotiations, which participants must respect in their tenders. The time of submission of preliminary tenders will be specified at the next stage of the procurement procedure, i.e. in the invitation to submit preliminary tenders within the meaning of the Act. Section 61(5)
