… offer data unambiguously identifying the offered assortment or failure to submit, together with the offer, Annex 5 to the FTZ, the Contracting Authority will reject the offer on the basis of Art. 1 point 5 of the Act. The name ‘producer’ should be understood as the name of the company under which the offered assortment is sold or the entrepreneur placing the goods on the market in the territory of the Republic of Poland. 6. The procurer shall require that the ICT products offered do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of state security; 2) an ICT product, the type of which was specified in the decision on the recognition of the supply as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system; Failure to comply with the above requirement will result in the rejection of the offer pursuant to Art. 1 point 17 or point 19 of the Public Procurement Law Act (i.e. Journal of Laws Journal of Laws of 2026, item 793 as amended). 7. Used by the Ordering Party, in this documentation: • trade marks, patents or origin, sources or a specific process that characterises the products or services provided by a specific economic operator as referred to in Article 99(1)(b) and (c) EUTMR. 4 of the Act, and • standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Art. 4 of the Acts - constitute only a qualitative, functional, technical, technological or aesthetic standard and in all cases of their use the use of materials, equipment, technical systems and other equivalent elements, hereinafter referred to as ‘equivalent solutions’, is allowed. The use of ‘restrictive wording’ is not intended to give preference to the manufacturer or his product, but only to indicate a solution that should have characteristics and attributes that are not inferior to those given in this documentation. In the case of tenders containing equivalent solutions, the Employer will verify them in terms of meeting the requirements of individual items of the requirements contained in this documentation. The Contractor is obliged to prove in the tender the equivalence of the materials offered. The Ordering Party will not consider the offered solutions as equivalent if they are of worse properties or characteristics than indicated in this documentation. 8. The contracting authority does not allow the submission of partial tenders. 9. The Contracting Authority allows the subcontractor to be entrusted with the performance of part of the contract. 10. The Contracting Authority requests the Contractor to indicate in the tender the parts of the contract which it will entrust to Subcontractors and to indicate the names of any Subcontractors, if they are already known. 11.
