… 2024.1620, as amended), hereinafter: UoWM), placed on the market and used in the territory of the Republic of Poland in accordance with the applicable regulations - in the scope of the following tasks and items: - Task No. 2 item. 6, 7, 10 c) dietetic food (medical food) - applies to task no. 9. d) dietary foodstuff or dietary supplement - applies to edibles. 2 Item 3 e) cosmetics - applies to task no. 2 item. 4, 5, 8 5. The contracting authority requires that the shelf life of all products offered be a minimum of 12 months from the date of delivery to the contracting authority's premises. 6. Whenever the subject-matter of the contract refers to sales denominations, an equivalent preparation may be offered. By the term "equivalent product", the Purchaser understands a product that meets the requirements for: active substance, dose, form, route of administration and pack size in relation to the subject described by the Ordering Party in Annex 2 to the specification. 7. The Ordering Party allows an equivalent medicine provided that it is possible to reimburse the costs of treatment by the National Health Fund (if applicable). 8. The Contractor will ensure the supply of medicinal products labelled and secured in accordance with Commission Delegated Regulation (EU) 2016/161 of 2 October 2015 supplementing Directive 2001/83/EC of the European Parliament and of the Council. According to this Regulation, each medicine should be protected by a unique identifier (UI) as well as a special label to protect against unauthorised opening (ATD) – it concerns a series of medicinal products subject to prescription and some non-prescription medicines released for the market after 9 February 2019). 9. In the event that the offered medicinal product has been withdrawn from production or is temporarily unavailable and the date of resumption of production is not known, the valuation of the item shall be provided only by the Contractor who has sufficient stock for the entire duration of the contract. Other Contractors shall indicate in the unit price form, in the item in which the product withdrawn from production or temporarily unavailable is displayed, that the product has been withdrawn from production or temporarily unavailable. To compare offers, the Ordering Party will not take into account the value of items of products withdrawn or temporarily unavailable, i.e. it will limit the subject of the contract for products withdrawn from production or temporarily unavailable, unless they are valued by all participants in the procedure on a given task. 10. The Ordering Party has the right to order a smaller quantity of products, except that not less than 60% of the quantity specified in the unit price form. 11. The Ordering Party pursuant to Art. 2 of the Public Procurement Act awards the contract in lots, each of which is the subject of a separate procedure. 12. The order consists of 4 tasks, the detailed description of which is included in FCJ 13. The contracting authority does not allow variants to be submitted.
