… be unencumbered by rights for third parties. 5.The detailed scope of the subject of the contract, a description of the Ordering Party's requirements in terms of implementation and acceptance are determined by: Annex 5 to the FVC of Annex 1, Annex 3 to the FVC. 6.The Ordering Party requires submitting with the offer the means of proof that the offered subject of the contract is in accordance with the requirements of the Ordering Party specified in the description of the subject of the contract, as specified in Annex No. 5 to the FTZ. 7.The Contracting Authority shall provide for the possibility of supplementing the evidence in question if the Contractor has not submitted it or the evidence in question is incomplete. The supplement shall not apply if, despite the submission of the measure of inquiry in question, the tender is rejected or there are grounds for invalidating the procedure. The contracting authority may request explanations from economic operators concerning the content of the evidence in question. 8.The Ordering Party shall not call for submission and/or supplementation if the measure of evidence in question serves to confirm compliance with the characteristics or criteria set out in the description of the criteria for the evaluation of tenders or, despite the submission of the measure of evidence in question, the tender is to be rejected or there are grounds for cancelling the procedure 9.In cases where: 1) the subject of the contract is described in the documentation of the procedure by means of standards, approvals, technical specifications and reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Acts, 2) the documentation of the proceedings refers to devices, software or systems or products with the indication of trademarks, patents, proper names, origin, source or specific process that characterizes the products or services provided by a particular manufacturer or supplier - it is assumed that such indications are accompanied by the words "or equivalent". These signs are used only to describe the minimum technical, functional and functional parameters that the subject-matter of the contract should meet. The contracting authority will consider as equivalent solutions devices, systems and other equipment covering the subject of the contract with not inferior technical, functional and functional parameters than those indicated in the OIP and other documents of the procedure. 10.The Contractor who invokes solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the devices and systems offered by him meet the requirements specified by the Ordering Party in Annex 5 to the FTZ. 11. The Contractor relying on equivalent solutions is obliged to prove to the Ordering Party, in particular by the means of evidence referred to in Articles 104-107 of the Act, that the proposed solutions meet the requirements specified by the Ordering Party to an equivalent extent. 12.The Customer requires that the delivered equipment is brand new, i.e. manufactured not earlier than 12 months before delivery and is not used for exhibition purposes and comes from a legal source. In the event of doubt as to the compatibility of the equipment offered with the subject-matter of the contract, in particular as regards its legality, the Contracting Authority shall be entitled to request
