… Poland in accordance with the rules set out in Article 3 or 4a of the Pharmaceutical Law Act. 5. Offered medical devices must comply with the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, No. Journal of Laws 2024, item 1620) and, where applicable, in implementing acts issued pursuant to that paragraph. 6. The Ordering Party allows the submission of an equivalent tender in the scope of lot 22. The Ordering Party informs that any proper names used in the description of the subject of the contract determine the required standard of the ordered assortment. The Ordering Party allows submission of tenders with equivalent quality parameters, having the same chemical composition in terms of basic substances. Proof of the fulfilment of the equivalence condition shall lie with the Contractor. 7. In the event that the Ordering Party used in the description of the subject of the contract the indications of standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the PPL Act, equivalent solutions are allowed. Whenever a standard is indicated in this FTZ or in the annexes to the FTZ, it must be assumed that the term ‘or equivalent’ is used in relation to it. Where the description of the subject-matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1. 1 point 2 and paragraph. 3, the contracting authority may not reject the tender solely because the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract refers, provided that the economic operator proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107, that the solutions proposed satisfy to an equivalent extent the requirements set out in the description of the subject-matter of the contract. 8. The Ordering Party requires the submission of tenders in electronic form. A detailed description (instruction) of the submission of tenders in electronic form is contained in paragraph XIV of the FTZ. The Contracting Authority informs that in the public procurement procedure in question the so-called Public Procurement Procedure will be applied. ‘reverse order of evaluation of tenders’, as referred to in Article 139 of the Public Procurement Act. When applying the above procedure, the contracting authority will first examine and evaluate the tenders and then make a qualitative selection of the contractor whose tender was the highest rated in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. 14. The contractor may subcontract part of the contract to a subcontractor. 15. The contracting authority does not allow variants to be submitted. 16.
