Each time, in all cases, in which the Ordering Party describing the subject of the Order by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Act, the Ordering Party allows solutions equivalent to those described, if they allow to obtain features or parameters not worse than those referred to. This means that the Contractor may apply the solutions described by the Contracting Authority ‘or equivalent’. 6. The Contractor who relies on solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the supplies, services or works offered by him meet the requirements specified by the Ordering Party. The condition for the use of equivalent solutions is written approval by the Employer. Differences between the standards referred to and their equivalents must be described in detail by the Contractor and submitted to the Ordering Party during the performance of the Order – for approval. 7. The Contracting Authority informs that the local vision is mandatory for Contractors. Before submitting a tender, the Contractor must inspect the place where the works that are the subject of the submitted tender will be carried out and familiarize himself with the conditions for the performance of the contract and the difficulties encountered. Deadline for carrying out the vision: the first deadline is 27.08.2026; the second deadline is 21.09.2026. Entrance to the facility in order to carry out an on-site inspection requires notification of the participants of the inspection by completing, respectively, Annexes 1, 2, 3 to the Instructions for granting and supervising access permits and controlling the movement of materials and vehicles at PSE S.A. power stations and submitting them via the Procurement Platform (the ‘questions/information’ tab), at the latest 5 working days before the agreed date of the inspection. Location of the on-site visit: SE RECŁAW is located in the town of RECŁAW. In the case of Contractors jointly applying for the contract in question, the presence of one of them is sufficient. In accordance with Art. 1 point 18) of the Act, the Employer will reject an offer that was submitted without a local inspection or without checking the documents necessary for the performance of the contract available on the spot with the Employer, if the Employer required it in the procurement documents.
