… point 1, by submitting to the Contractor by electronic means an appropriate declaration of intent to activate the option, specifying the quantity and type of equipment indicated by the Contractor in the tender form – Annex 1 to the FTZ, 2) the value of the equipment ordered under the option right will be in accordance with the unit prices indicated by the Contractor in the tender form – Annex 1 to the FTZ, 3) the deadline for the execution of the contract covered by the option right: up to 90 days from the date of placing the order covered by the option right, 4) exercising the option right does not constitute an amendment to the contract. The Contractor shall not be entitled to any claim against the Ordering Party in the event that the Ordering Party does not exercise the right of option. The decision to implement the contract covered by the option right is a unilateral power of the Contracting Authority, 5) the provisions of the draft contract – Annex 5 to the FTZ concerning the basic contract apply to the contract covered by the option right, unless otherwise specified. 5. A detailed description of the subject-matter of the contract is set out in Annex 6 to the FTZ – Description of the subject-matter of the contract. 6. Place of delivery of equipment: University of Gdańsk IT Centre, Prof. Maria Janion 7, 80-309 Gdańsk. 7. The customer requires a warranty for the equipment for a period of 36 months. The details of the guarantee are set out in Section 7 of the draft contract – Annex 5 to the FTZ. 8. In the description of the subject-matter of the contract, constituting Annex 6 to the FTZ, the Contracting Authority described the requirements for management systems relating to the production process of the equipment offered by reference to the standards indicated in items 14 of Tables 1 and 2 of the description of the subject-matter of the contract. Whenever those standards are indicated in the content of the EMS, including the annexes to the EMS, such indication shall be understood to be accompanied by the words ‘or equivalent’. Thus, the Contracting Authority allows solutions equivalent to the standards indicated in items 14 of Tables 1 and 2 of the description of the subject-matter of the contract, in accordance with Art. 4 and 5 PPL. Equivalence should be understood as meaning that the equipment offered comes from production covered by an implemented and up-to-date management system which satisfies to an equivalent extent the requirements set out in items 14 of Tables 1 and 2 of the description of the subject-matter of the contract. The equivalent solutions used must correspond to the type and scope of the objectives pursued by the standards referred to in items 14 of Tables 1 and 2 of the description of the subject-matter of the contract. 9. Due to the fact that the possibility of different equivalent proposals is allowed, the Contractor is required to verify and treat all solutions as interlinked. Demonstration of equivalence, i.e. equivalent fulfilment of the requirements specified by the Employer in the description of the subject of the contract, lies with the Contractor. If equipment from production covered by a management system complying with an equivalent standard or other equivalent solution to the standards indicated in items 14 of Table 1 and 2 of the description of the subject of the contract is offered, the Contractor is obliged to indicate this solution in point 6 of the Tender Form, constituting Annex 1 to the FTZ, provide information about the solutions offered
