The estimated demand for electricity for facilities in the period from 01.01.2027 to 31.12.2027 amounts to a total of 1 987 594 kWh. 6. The Contracting Authority declares that: 1) The procedure for selecting an electricity supplier in the form of a tender is carried out once again. 2) He concluded an agreement for the sale of electricity with Respect Energy S.A., ul. Bonifraterska 17, 00-203 Warszawa – the contract is concluded for a fixed period, until 31.12.2026 and does not require notice of termination. 3) He concluded an agreement for the provision of electricity distribution services with the Distribution Network Operator - PGE Dystrybucja SA for an indefinite period. 4) The forecast of energy consumption indicated above and in the description of the subject of the contract is only an approximate value, which may change during the performance of the contract. Actual energy consumption (smaller or greater than the forecast indicated in Annex 10 to the FTZ) will depend only on the actual needs of the Ordering Party, and the Seller is obliged in each case to apply the energy prices offered in the tender. 5) Up to 14 PPE are connected photovoltaic micro-installations, the production of which is consumed for own needs, and the Contractor selected in the procedure will provide for these PPE the service of receiving energy fed into the DSO's network from micro-installations on the basis of separate contracts concluded in accordance with the model used by the Contractor. 6) To the Contractor selected in the proceedings, the Ordering Party will provide data on EPP in electronic form (MS Excel file). 7) The Ordering Party agrees to conclude the contract by correspondence. 7. The estimated demand for electricity is only indicative, used to compare offers and in any case does not constitute an obligation on the part of the Contracting Authority to purchase energy in the given quantity. 8. The Contractor may not claim any financial claims from the Ordering Party (e.g. compensation) if, during the term of the contract, the Ordering Party purchases from the Contractor less or more electricity than the forecasted amount indicated in the description of the subject of the contract - Annex 10 to the FTZ. 9. The energy supplier is obliged to have a distribution agreement concluded with the Distribution System Operator (DSO) competent for the Customer's facilities, at the latest on the date of conclusion of the contract regarding the order in question and for a period not shorter than until 31.12.2027. The Contractor undertakes to provide the Ordering Party with quality standards of service in accordance with the binding provisions of the Energy Law. 11. The Contractor will be obliged to act as an entity responsible for commercial balancing for electricity sold under the subject-matter of the contract. 12. The subject of the contract does not include the provision of electricity distribution services, and electricity distribution services will be provided on the basis of separate agreements concluded by the Ordering Party with the relevant Distribution System Operator – the DSO data are contained in Annex 10 to the FTZ. 13.
