… non-rejectionable tender is received for a given task, the Contracting Authority shall conclude a framework contract with one Contractor. 4. In Annex 7 to the FTZ, the contracting authority indicated the minimum technical parameters for devices and equipment. The contractor can offer devices and equipment with higher parameters. Offering devices and equipment that do not meet the minimum requirements of the Ordering Party will result in rejection of the offer on the basis of Art. 1 point 5) of the Public Procurement Act, as not meeting the conditions of the contract. 5. Details of the order are included in the FTZ and annexes. 6. The value of the framework contract will not exceed PLN 34 440 000.00 gross (the amount that the Contracting Authority intends to allocate to the performance of the contract), including: for task 1: 16 848 540,00 zł for task 2: PLN 1 706 010.00 for task 3: Settlement for delivered deliveries will take place on the basis of separately concluded implementation contracts based on unit prices indicated in the offer form - Annex 1 to the FTZ, subject to § 6 of the draft provisions of the contract. 7. Contractors may jointly apply for a contract. 8. In the case of consortia and civil-law partnerships, a separate declaration of non-exclusion, eligibility or selection criteria must be provided for each of the co-contractors. Such a declaration confirms that the conditions for participation in the procedure or the selection criteria are met and that there are no grounds for exclusion only in respect of the consortium member or partner concerned (Art. 4 of PZP). This means that each of the co-contractors demonstrates only their own capabilities (resources) in the declaration. 9. In the case referred to in para. 1, Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude the public contract. 10. The tender must be signed in such a way that it legally binds all Contractors acting jointly. 11. Where the Contractors jointly apply for a contract, the documents and declarations referred to in points 1.2 and 2.1 of Section VIII shall also be submitted by the Contractor jointly applying for the contract. Provisions of Section VIII para. 2.2-2.5 shall apply mutatis mutandis. 12. The contractor may subcontract part of the contract to a subcontractor. 13. The Contracting Authority shall request the Contractor to indicate, in the tender, the part of the contract which it intends to entrust to subcontractors and to indicate the names of any subcontractors, if they are already known. The above is indicated in Annex 1 to the FTZ. If the Contractor does not intend to perform the contract with subcontractors, enter ‘not applicable’ or other similar wording in Annex 1 to the FTZ. If the Contractor leaves this point of the form blank (empty box), the Contracting Authority will consider that the order will be executed by its own means, without the participation of subcontractors. 14. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract.
