… jointly shall be required to appoint a representative to represent them in the procedure or to represent them in the procedure and conclude the contract for the public contract in question. All correspondence will be conducted by the Ordering Party only with a proxy. 4.2. Condition concerning entitlement to engage in a specific economic or professional activity referred to in Article 112 para. 2 point 2) of the Public Procurement Act (if it has been formulated), will be met if at least one of the Contractors jointly applying for a contract has the right to conduct a specific economic or professional activity and performs the services for which these rights are required. 4.3. With regard to conditions relating to education, professional qualifications or experience, the Contractors jointly applying for the contract may rely on the capacities of those of the Contractors who will perform the services for which those capacities are required. 4.4. In the case referred to in Chapter I, para. 4, clause 4.2. (if any) and point 4.3. FTZ, Contractors jointly applying for a contract shall attach to the tender, as appropriate, a statement indicating which services will be provided by each Contractor. 5. PROTECTION OF PERSONAL DATA COLLECTED BY THE CONTRACTOR IN THE PROCEDURE A detailed description is included in Chapter I, para. 17. SWZ. 6. REQUIREMENTS REGARDING THE PROTECTION OF DUE IMPLEMENTATION OF THE CONTRACT The Contractor shall be obliged to lodge a performance bond in the amount of 5% of the total price indicated in the tender prior to the conclusion of the contract. The Contractor shall lodge a security separately for each of the lots for which his tender is deemed to be the most advantageous.
