Pursuant to Article 95 of the Public Procurement Act, the contracting authority requires the contractor, subcontractor or subcontractor to employ persons performing the work covered by the contract on the basis of the employment relationship, in accordance with the draft provisions of the contract annexed to the FTZ – it applies to persons performing: construction works, installation works included in the scope of the contract. This requirement does not apply to activities covered by the subject-matter of this contract falling within the scope of the duties of persons performing functions in accordance with Chapter III. 7.7.2(a) I. SWZ: construction managers, works managers. The contractor may subcontract part of the contract. The Ordering Party allows equivalent solutions described in the FTZ - in accordance with the provisions of Chapter II of the Agreement. 4 point 1. SWZ. The Ordering Party reserves that all materials (products) which may be included in the FTZ or any other document integral with the FTZ are not intended to infringe Article 99 of the Public Procurement Act, but are only intended to clarify the Ordering Party's quality and technological expectations. This should be understood as specifying the required minimum performance, functional and technical parameters or quality standards. In accordance with Art. 4 of the Public Procurement Law Act if the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in para. 1 point 2 and paragraph. 3 of the Public Procurement Law, and such references are accompanied by the expression ‘or equivalent’, the Contracting Authority shall allow an equivalent solution as described in each such standard, technical assessment, technical specification and technical reference system. As an equivalent solution, solutions should be understood that guarantee the correct implementation of works and ensure that technical parameters are not inferior to those assumed in the procurement documents, do not lower the standards specified in the documentation and ensure the performance of the contract in accordance with the expectations and requirements of the Ordering Party specified in the FTZ and those that are characterized by parameters / descriptions not inferior to those required and included in the documentation. Where the description of the subject-matter of the contract refers to performance or functional requirements referred to in Art. 1 point 1 Public procurement law, the Contractor may rely on the conformity of the works, supplies or services offered with the performance or functionality requirements specified by the contracting authority with the relevant standards, if these standards, technical assessments, specifications and technical reference systems relate to the performance or functionality requirements specified by the contracting authority. All indications (names/marks/standards, etc.) indicated in the procurement documents shall be accompanied by the words "or equivalent". Therefore, the Ordering Party, as indicated above, in any such case allows the use of materials, equipment, equivalent solutions. The Contractor may, where appropriate, confirm compliance with the conditions for participation in the procedure.
