… The subject-matter of the contract was divided into seven lots in accordance with Chapter IV of the FTZ. 4. Detailed description of the subject-matter of the contract Detailed description of the subject-matter of the contract for individual lots shall be determined by: Annex 2.1. – OPZ – Part 1 – Supply of backhoe loaders Annex 2.2. – OPZ – Part 2 – Supply of a multi-purpose truck Annex 2.3. – OPZ – Part 3 – Supply of two VAN vehicles Annex 2.4. - OPZ - Part 4 - Supply of a used special vehicle - basket lift. 5. The Ordering Party informs that it does not require that the submission of the tender be preceded by a local inspection and does not provide for the convening of a meeting of Contractors in order to clarify the content of the FTZ. 6. Equivalence The Employer informs that where it has described the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Act, the Employer allows solutions equivalent to those described. In view of the above, it should be assumed that each time in this FTZ and its annexes such reference is accompanied by the words ‘or equivalent’. The Contractor who invokes solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the solutions proposed by the Contractor meet the requirements specified in the description of the subject of the contract to an equivalent extent. 7. Condition of vehicles, machinery and equipment. All vehicles, machinery and equipment offered (with the exception of a specialised basket lift vehicle) must be brand new, complete and ready for use, free from physical and legal defects, must not be used, displayed or remanufactured, manufactured in 2025 or 2026. The contracting authority shall not request the evidence in question.
