However, in the case of drugs dedicated to specific patients, the Ordering Party reserves the right not to implement a given drug. 2) The quantity of ordered goods shall not be less than 50 % of the value of the Contract. (3) The medicinal product must be supplied in accordance with the applicable regulations. 4) The Ordering Party shall mean the purchase and delivery of medicinal products to the Hospital Pharmacy carried out on a continuous basis at the request of the Ordering Party within the time limits specified by it, i.e.: a) cito – up to a maximum of 24 hours b) scheduled – up to 48 hours from placing the order by the Ordering Party in writing sent by e-mail. If the delivery falls on a non-working day or outside the working hours of the Hospital Pharmacy, the delivery will take place on the first working day after the deadline. 5) The Contractor must guarantee the possibility of placing orders in writing sent electronically from Monday to Friday from 8 a.m. to 4 p.m. 6) When submitting an offer, the Contractor shall simultaneously submit a statement on the security of supplies at his disposal for the entire duration of the contract. 7) In the event of non-performance of the contract within the period specified in the contract, the Ordering Party shall make an intervention purchase of the medicinal product and the Contractor agrees to cover the resulting difference between the intervention purchase price and the price resulting from the contract. 8) The Ordering Party requires that the medicines subject to the present proceedings be those included in the list – the list of reimbursed medicines (in terms of the medicines concerned) and enable the Ordering Party to report to the NFZ therapies involving their use (use), understood as the payment of medical costs by the Payer-NFZ. 4. Equivalent information: 1) In Annex No 2 to the tender, in the column ‘Duration, form and size of the equivalent package offered by the Contractor’, it is permissible to submit an equivalent preparation in the tender together with the dose, form and appropriate size of the package. 2) The Ordering Party allows an equivalent medicinal product provided that it will be possible to refund the costs of treatment by the National Health Fund. 3) The packaging of an equivalent preparation may not deviate from the permissible packaging size of a given item specified in Annex No 2 to the FTZ – Price Offer. 4) Equivalent, which will contain a different dose and form than those listed in Annex 2 to the FTZ – Price Offer will not be taken into account. 5) If an equivalent medicinal product is offered, in Annex 2 to the SPC – Price Offer, in the columns entitled: ‘Net unit price’ ‘Net value’ ‘Gross value’ values for the equivalent medicinal product offered shall be reported. 5. The Ordering Party allows the submission of partial offers, i.e. for individual complete Packages. In the event that the Contractor submits the most advantageous offers for more than one of the Packages, a single contract will be concluded in which each Package will constitute an independent element to which all its provisions will apply, including the possibility of its termination. 6.
