For the delivered spare parts, the Contractor will provide a guarantee under the conditions indicated in the ST (Annex No 1 to the FTZ) and in the Contract Model (Annex No 2 to the FTZ). During the period equal to the period of the guarantee granted, the subject of the contract will be covered by the warranty. 6. The subject of the Order will be carried out in accordance with the documentation of the procedure, i.e.: FTZ and its annexes, in particular ST and the Model Agreement (Annex 2 to the FTZ). 7. The Ordering Party allows the submission of a tender for parts equivalent to the original parts indicated by the Ordering Party in Annex 1 to the ST. If equivalent parts are offered, they must have the same parameters as the original parts, while meeting the functional requirements of the original parts and will be compatible with the other components of the vehicle. The Ordering Party requires that the manufacturer of equivalent parts has a Quality Management System implemented in his company. A contractor who offers to supply equivalent parts shall: 1) declare in the tender form that it offers and will supply equivalent parts, 2) indicate in the tender the items from Annex 1 to the ST for which it offers equivalent parts, 3) include in the tender the data of the equivalent parts offered, i.e. the names of equivalent parts, manufacturers of equivalent parts, catalogue number/identification of equivalent parts, while it is the Contractor's responsibility to describe the equivalent parts offered in the tender in a way that allows the Ordering Party to clearly determine which equivalent parts the Contractor offers in a given item of the tender form (a given item of Annex 1 to the ST), 4) submit together with the tender the evidence referred to in point 12 of the tender, i.e.: a) a certificate of implementation of the Quality Management System, issued by an accreditation body, for the manufacturer of the equivalent parts offered, b) an assessment of the significance of the change (performed on its own and at its own expense) concerning the equivalent parts offered. The result of such an assessment must be that it is classified as a non-substantial, non-safety-related change. On the basis of the assessment of the significance of the change, the contractor will submit a declaration (in accordance with Annex 4 to the ST) confirming the following equivalence criteria: the reversibility of the change and the consequences of the failure are low; a statement issued by the vehicle manufacturer or a notified body and authorised by the Office of Rail Transport (UTK) that these parts may be used in vehicles operated in Metra Warszawskie Sp. z o.o. for which a ‘Type Approval Certificate for Railway Vehicles’ No T/2001/0137 has been issued by the Chief Inspector of Railways, No T/2015/0109 and No PL 59 2023 0059 by the President of the Office of Rail Transport pursuant to the Rail Transport Act of 28 March 2003, that they are substitutable with original ones with the same parameters and requirements; full technical documentation – operational and operational, together with the WTWiO. The Ordering Party will acquire the right to use the above-mentioned documentation on the terms set out in the Model Agreement (Annex 2 to the FTZ).
