… part No 1 of part No 2, part No 3 and part No 4 – constituting Annex 1 Assortment and quantity list for individual delivery points for part No 1, part No 2, part No 3, part No 4 specify: 1) Assortment-quantitative list for individual delivery points in the scope of part No 1 – constituting Annex No 2a to the FTZ; 2) Assortment-quantitative list for individual places of delivery in the scope of part No 2 – constituting Annex No 2b to the FTZ; 3) Assortment-quantitative list for individual delivery points in the scope of part No 3 – constituting Annex No 2c to the FTZ; 4) Assortment-quantitative list for individual places of delivery in the scope of part No 4 – constituting Annex No 2d to the FTZ; ATTENTION! The contracting authority will present as annexes the assortment and quantity lists for individual delivery points for parts No 1,2,3,4 packed in a single file in the ZIP format, that file in the ZIP format will be placed on the purchasing platform under the tab ‘Annexes to the procedure’ as Annex No 2 to the FTZ. DETAILED REQUIREMENTS OF THE CONTRACTOR IN RESPECT OF THE DELIVERY 1. The Ordering Party reserves the right to exercise the option right under the Agreement (option right - 100% of the basic order) to the extent not exceeding the range and quantities included in the column "OPTION RIGHTS" in the Annex to the Agreement. 2. The final amount of food options purchased under the law will depend on the Ordering Party's current needs and financial resources. 3. Food purchased under the option right must meet all the requirements as for a guaranteed order. 4. The contracting authority reserves that the part of the contract defined as the ‘right of option’ is an entitlement and not an obligation of the contracting authority. The Ordering Party may not exercise the right of option, in particular in the event of failure to obtain funds for this purpose, and the Contractor shall not be entitled to any claims in this respect, which the Contractor hereby accepts by signing this contract. 5. The Ordering Party guarantees placing orders under the basic order for the delivery of goods at the level of not less than 30% of the gross value of the Agreement referred to in § 4 sec. 4 of the model contract constituting Annex 3 to the FTZ. The implementation of the Agreement in the remaining scope will depend on the actual needs of recipients resulting from the variable number of entitled to nutrition and the financial resources allocated for this purpose. 6. The Contractor shall not be entitled to any claims for compensation for failure to place and perform orders higher than 30% of the maximum gross value of the basic contract. 7. If the Ordering Party exercises the right of option, the Contractor shall be entitled to remuneration at unit prices as for a guaranteed order. 8. The full scope of the option right is described in the model contract attached as Annex 3 to the FTZ. 9.
