The subject-matter of the contract is described in detail in the Technical Information Sheet (Annex No 2 to the SWZ Part 1 - 3) and valued in the Assortment and Price Form (Annex No 3 to the SWZ Part 1 - 3). The contracting authority requires that the products offered meet the requirements contained in the Technical Information Sheet. Detailed conditions and rules for the implementation of the contract are set out in the Model Contract (Annex 6 to the FTZ). 4. When describing the subject of the contract, the Ordering Party mentioned the name of the manufacturer and the catalog numbers of the laboratory equipment, in order to indicate the quality standards of the product and to accurately determine the subject of the contract. In cases where the description of the subject-matter of the contract indicates trademarks, patents or origins, sources or a specific process that characterizes the products supplied by a particular Contractor, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and comprehensible way. In such situations, any indication of trade marks, patents, origin, source or particular process shall be read with the words ‘or equivalent’. 5. The Ordering Party, in accordance with Art. 6 PPL, allows for the possibility of submitting equivalent tenders, i.e. tenders with parameters and properties not worse than those specified by the Employer in the Technical Information Sheet (Annex 2 to the SWZ, parts 1 - 3). 6. In the case of offering a product other than that provided by the Ordering Party, the Contractor is obliged to demonstrate in the offer that the deliveries offered by him meet the requirements specified by the Ordering Party by providing, respectively, in the Assortment and Price Form constituting Appendix No. 3 to the SPC (Parts 1 - 3), the name of the product offered, the name of the manufacturer and the catalog number, or other features clearly indicating the products offered. Equivalent products must: 1) Have the composition and characteristics as laboratory equipment specified in Annex 2 to the FTZ (parts 1 - 3), 2) Have the capacity and weight of packages as laboratory equipment indicated in Annex 2 to the FTZ (parts 1 - 3).
