… detailed description and scope of the subject-matter of the contract is determined by the description of the subject-matter of the contract - Annex 5 to the FTZ. 5. Place of performance of the contract: Faculty of Chemistry, University of Gdańsk, ul. Wita Stwosza 63, 80-308 Gdańsk, aule D1, D2, D3, D101, D102. 6. The Ordering Party requires a guarantee for the subject of the contract for a period of 48 months. The details of the guarantee are set out in Section 7 of the draft contract – Annex 4 to the FTZ. 7. The contracting authority provides for the possibility of carrying out a local vision. The date of the on-site visit should be agreed with the Contracting Authority. 8. If anywhere in the FTZ, including in the description of the subject-matter of the contract – Annex 5 to the FTZ, the standards referred to in Article 101(1)(c) EUTMR are indicated. 1 point 2 and paragraph. 3 PPL, it should be understood that such indication is accompanied by the words ‘or equivalent’ and the Contracting Authority allows offering solutions equivalent to those described. Equivalence should be understood as meaning that equivalent solutions will guarantee the performance of the contract in accordance with the description of the subject-matter of the contract and ensure that the requirements set out in the description of the subject-matter of the contract – Annex 5 to the FTZ – are met to an equivalent degree. The application must correspond to its type and scope, the objectives set out in the standards referred to in Article 101(1)(b) and (c) of the General Data Protection Regulation referred to in the description of the subject-matter of the contract. 1 point 2 and paragraph. 3 p.p. 9. Due to the fact that the possibility of different equivalent proposals is allowed, the Contractor is required to verify and treat all solutions as interlinked. Demonstration of equivalence, i.e. equivalent fulfilment of the requirements specified by the Employer in the description of the subject of the contract, lies with the Contractor. If equivalent solutions are used in the tender, the Contractor is obliged to indicate the relevant option in point 6 of the tender form – Annex 1 to the FTZ, and is also obliged to indicate in his tender which standards, to which the description of the subject of the contract refers, have been replaced and indicate what equivalent solutions he proposes in their place. The contracting authority will not reject the Contractor’s tender solely because the delivery offered does not comply with the standards to which the description of the subject-matter of the contract refers, provided that the Contractor proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107 of the Public Procurement Law, that the proposed solutions meet the requirements set out in the description of the subject-matter of the contract to an equivalent degree (Article 101(1)(b) EUTMR). 5 of PZP). 10. The contracting authority, after the conclusion of the contract, provides for applying for a 0% VAT rate in the field of network switches pursuant to Art. 14 point 1 of the VAT Act of 11 March 2004 (Journal of Laws of 2025, item 775 as amended).
