What the buyer is looking for
The contracting authority shall establish a dynamic purchasing system for the purchase of gas fuel for the operation of CNG buses, with the possibility of refuelling, in the amount of 1.139.928 kilograms / 12 months planned for the entire duration of the system (72 months). The expected maximum size of each contract to be awarded under the DPS is 1.139.928 kilograms per 12 months. During the bidding phase, the contracting authority intends to meet its procurement needs by concluding framework contracts, and the timeframe for framework contracts is planned to be between 3 and 12 months. … apply the provisions of the Public Procurement Act. Pursuant to Section 107(2), the precise technical specifications and contractual conditions for the specific public procurements to be implemented in the system shall be made available to those submitting a valid request to participate in the DBR at the same time as the invitation to tender is sent. The quantity indicated was determined on the basis of previous experience in use, so-called experience quantity and the technical parameters of the buses, the quantity purchased may differ from these data. In order for the application to be valid, the applicant must declare, in accordance with the model declaration published in the Public Procurement Documents, that it accepts the contracting authority’s general terms and conditions. After the successful completion of the participation phase of this procedure, when a specific procurement need arises, the Contracting Authority shall send the invitation to tender through the ERC to the candidates identified as suitable. During the 36-month period of the scheme, any economic operator may join the scheme if it submits a request to participate through the EQF and if it is deemed suitable. In the second stage of the procedure, the contracting authority intends to set a time limit for the submission of tenders of at least 3 working days in each invitation to tender. Candidates must declare in their request to participate that they accept the time limit for submitting tenders of at least 3 working days. (in the form of ‘yes’ or ‘no’). If all candidates admitted to the dynamic purchasing system reply ‘Yes’, the Public Procurement Act shall apply. The contracting authority shall be deemed to have concluded an agreement within the meaning of Section 84(6) and shall be entitled to set a time limit for the submission of tenders of at least 3 working days in each invitation to tender. In the event of a ‘No’ answer, the Contracting Authority shall set a time limit for the submission of tenders of at least 10 calendar days, with the proviso that the Contracting Authority and the Candidates may agree on a shorter period for the duration of the DBR. In the second stage of the procedure, which is the bidding phase, the tenderer must submit the documents or declarations specified in the procurement documents and technical specifications issued during the bidding phase. Another task of the successful Tenderer is to ensure that the fuel to be procured is refuelled into the vehicles with its operating equipment, under the conditions set out in the procurement documents and technical specifications issued at the bidding stage. During the bidding phase, the contracting authority may implement each procedure either by providing one or more lots. The contracting authority shall enforce a contractual penalty in the event of late or defective performance by the tenderer and in the event of failure to perform. More detailed conditions for the performance of the FWC are set out in the GTC and in the draft specific FWC issued during the bidding phase.
