The given quantity value was determined on the basis of previous experience of use, so-called empirical quantity value, the quantity purchased may differ from this empirical data. In order for the application to be valid, the applicant must declare, in accordance with the model declaration published in the EQF, that he/she accepts the contracting authority’s general terms and conditions. After the successful completion of the participation phase of this procedure, when a specific procurement need arises, the Contracting Authority shall send the invitation to tender through the ERC to the candidates identified as suitable. During the 72-month period of the scheme, any economic operator may join the scheme if it submits a request to participate through the EQF and is deemed suitable. In the second stage of the procedure, which is the bidding phase, the tenderer must submit the documents or declarations specified in the procurement documents and technical specifications issued during the bidding phase. The delivery time is specified in the invitation to tender, but orders placed on the basis of specific framework contracts to be concluded as a result of the bidding phase are scheduled to be executed between 3 and 10 calendar days. The contracting authority may specify a different delivery date. During the bidding phase, the contracting authority may implement each procedure either by providing one or more lots. In the event of late or defective performance or failure to perform, the contracting authority shall enforce a contractual penalty and provide for a warranty. More detailed conditions for the performance of the FWC are set out in the GTC and in the specific draft FWC issued during the bidding phase. The contracting authority states that the GTC contain the general provisions of performance, from which it may lay down different provisions depending on the nature and presentation of the product, on the basis of the draft framework contract issued at the bidding stage, the contracting authority draws attention to Government Decree No 321/2015 of 30 October 2015.
