Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul acordului cadru. Cerinta se aplica inclusiv pentru subcontractanti pentru partea din contract pe care acestia urmeaza sa o realizeze, care vor completa informatiile aferente situatiei lor la nivelul unui DUAE distinct. Modalitatea de îndeplinire: Se va completa DUAE de către operatorii economici participanți la procedura de achizitie cu informațiile solicitate de către entitatea contractantă – informații referitoare la îndeplinirea cerințelor privind capacitatea de exercitare a activității profesionale.
