Operatorul economic trebuie sa dovedeasca faptul ca este legal constiuit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatiile care fac obiectul contractului. Obiectul contractului trebuie sa aiba corespondent in codul CAEN autorizat conform Legii 359/2004. Ofertantii, eventual subcontractanti/asociatii / terti sustinatori vor completa la nivelul DUAE, informatiile aferente situatiei lor. Documentele justificative urmeaza a fi prezentate la solicitarea autoritatii contractante, doar de ofertantul clasat pe primul loc (inclusiv pentru subcontractanti/asociatii / terti sustinatori) la finalizarea evaluarii ofertelor. În cazul în care ofertantul/candidatul intenţionează să subcontracteze o parte/părţi din contract, DUAE include şi informaţii privind partea din contract care urmează a fi eventual subcontractată şi va avea anexat acordul de subcontractare. Subcontractanţii pe a căror capacităţi se bazează ofertantul/candidatul trebuie să completeze, la rândul lor, DUAE separat, incluzând toate informaţiile care prezintă relevanţă din perspectiva capacităţilor subcontractanţilor pe care se bazează ofertantul/candidatul în cadrul procedurii de atribuire respective.
