Vergabeverfahren „BeamScan“ – Lieferung von Messtechnik für die TH Wildau

The text concerns a German public procurement procedure (UVgO) of the Technische Hochschule Wildau (Germany, Land Brandenburg) for the project “BeamScan – Erweiterung der Messtechnik für hochpräzise Laserstrahlprofilmessung und zeitaufgelöste Pulsanalysen”.

It sets out the legal framework (UVgO, VOL/B, ZVB‑Bbg, BbgVergG), the structure and content of bids, the eligibility/evaluation requirements for bidders (including from other EU member states), and the subsequent contractual conditions under German law.

The point of view is that of a German contracting authority in the state of Brandenburg.

In terms of required bid content and minimum qualification, the documents specify that offers must be submitted exclusively using the provided Angebotsvordruck (Formblatt 03) and in German, electronically via the Vergabemarktplatz Brandenburg, complete with all requested declarations and evidence.

Such as outlined in section 4.1 and in the Angebotsvordruck, the bidder must attach: (1) product descriptions/data sheets clearly proving compliance with the performance requirements; (2) a detailed price breakdown on a separately marked annex; (3) the “Eigenerklärung des Bieters” (Formblatt 04) including confirmations on trade registration, no insolvency/liquidation, proper payment of taxes/social security/Berufsgenossenschaft contributions, no serious offences, existence (or binding commitment to conclude before award) of a Betriebshaftpflichtversicherung with minimum cover of 500,000 EUR per claim for personal and 500,000 EUR for property/financial damage; (4) the “Vereinbarung BbgVergG” (Formblatt 05) on minimum labour/wage requirements including acceptance of contractual penalties; and (5) an extract from the Handelsregister or equivalent register in the bidder’s home country.

In the self‑declaration, the bidder must also state, for 2023–2025, number of employees and net turnover, confirm availability of the necessary technical equipment and list three comparable reference projects (with scope, value, term and contact details of the reference client).

A specific minimum is set: the average total turnover of the last three completed financial years must be at least twice the offered contract value, and the bidder must have at least one full‑time equivalent employee on average over these three years.

Non‑submission, incompleteness or incorrect declarations can lead to exclusion and further legal consequences; alternatively, an officially recognised pre‑qualification certificate may replace the evidence marked with (*).

Regarding the scope of the contract (what, how much, where, when), the procurement is divided into three lots: such as stated in the Ausschreibungs‑ und Bewerbungsbedingungen, Lot 1: delivery of one high‑resolution oscilloscope; Lot 2: delivery of high‑speed photodiodes with a bandwidth of 2 GHz; Lot 3: delivery of one M²‑measurement system in combination with beam profilers for beam profile analysis.

Place of performance / delivery and acceptance, unless otherwise specified in the award letter, is the seat of the receiving service of the contracting authority (TH Wildau) with deliveries “frei Verwendungsstelle” under the ZVB‑Bbg/VOL/B.

The procedural timeline is specified: 22.10.2026 publication; 04.11.2026 deadline for bidder questions; 06.11.2026 deadline for answering questions; 09.11.2026, 10:00 deadline for submission of tenders; 30.11.2026 anticipated award; 07.12.2026 end of bid validity/binding period – the bidder must keep its offer binding at least until this date.

Any changes to deadlines are communicated via the e‑tendering platform.

On award criteria and weighting, the procedure is purely price‑based.

Such as explicitly stated in section 9.2, the only evaluation criterion is “Preis” with a weighting of 100%.

The lowest bid price receives 10 points; all other offers receive points calculated as: Punkte Bieter = 10 × (Niedrigstpreis / Bieterpreis).

The offer with the highest total score receives the award, provided it meets all formal and eligibility requirements and prices are considered appropriate.

The contracting authority reserves the right to exclude offers with speculative item prices, i.e. where the bidder has deliberately shifted costs between items rather than pricing individual services at their true calculated cost, judged against the authority’s own cost estimates and the prices of other bidders.

Concerning risks and special conditions, the documents emphasise that incomplete, late, formally incorrect or altered bids will be excluded (e.g. failure to use the correct forms, missing names under § 126b BGB, changes to the tender/contract documents, or submission after the deadline).

There is no mention of a mandatory site visit; all communication and clarifications must take place via the Vergabemarktplatz; telephone enquiries are excluded.

For labour and social standards under the BbgVergG, the bidder undertakes far‑reaching obligations: such as allowing inspections of wage and employment records, ensuring subcontractors and labour hire companies submit equivalent declarations, and accepting contractual penalties of 1% of the contract sum per proven case of underpayment or obstruction of controls (max. 5% of the contract sum, capped at 250,000 EUR in total).

Additional contractual penalties for delay may be agreed under ZVB‑Bbg/VOL/B up to 5% of the value of the non‑usable part of the service (with an absolute cap of 8% in individually negotiated cases).

Subcontracting is allowed, but the main contractor remains fully liable; use of other companies’ capacities (Eignungsleihe) requires full submission of all relevant forms (especially Formblatt 09 & 10), a binding capacity commitment and, in some cases, joint and several liability.

The authority can require replacement of subcontractors or auxiliary companies that fail eligibility conditions; replacing them after submission generally needs explicit written approval.

Bidding consortia must provide a signed Bietergemeinschaft declaration, appoint a lead member and accept joint and several liability, and they may not simultaneously bid as individual tenderers or in several consortia.

Regarding contradictions or corrections within the documents, there is a notable inconsistency between the Ausschreibungs‑ und Bewerbungsbedingungen and the Angebotsvordruck concerning Lot 2: the former consistently refers to “Lieferung von High‑Speed‑Photodioden mit einer Bandbreite von 2 GHz”, whereas one place in the Angebotsvordruck lists “Lieferung von Akustik‑Messtechnik” for Lot 2. Based on the contractual hierarchy in ZVB‑Bbg/VOL/B (§ 1: in case of contradictions, the Leistungsbeschreibung and specific contractual conditions take precedence over other documents) and the clear, repeated definition of Lot 2 in the Ausschreibungsbedingungen, this “Akustik‑Messtechnik” wording is to be treated as a likely clerical error in the form.

The applicable content for Lot 2 is therefore the description in the Ausschreibungs‑ und Bewerbungsbedingungen and the Leistungsbeschreibung (i.e. high‑speed photodiodes, 2 GHz).

Where further contradictions arise, the hierarchy given in the ZVB‑Bbg and in section 1.5 of the Ausschreibungs‑ und Bewerbungsbedingungen applies: first the client’s tender and contract documents in their latest version (including clarifications/Bieterfragen), then the contractor’s offer, then ZVB‑Bbg with VOL/B, and lastly supplementary conditions from the BbgVergG.

Tactics

When contracts were awarded in this country and sector, there was usually a single bid in the end. A solid bid has a real chance here. (Based on 12,100 completed awards — not a statement about this procedure.)

This procedure allows 18 days between publication and deadline — typical in this country is 32 (median of 20,071 procedures). Much tighter than usual: the first week counts.

The deadline falls on a Monday — your last full working day is the Friday before. Have evidence and guarantees together by Thursday.

Foreign bidders

In Germany · Laboratory & optical equipment, 578 contracts went to foreign companies over the last 3 years (of 12,560 recorded awards) — mostly from France, Netherlands, United Kingdom.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
