Vergabeverfahren BALM – Modell zur Schätzung von Gütertransportkosten

The input text concerns a national public tender procedure in Germany conducted by the Bundesamt für Logistik und Mobilität (BALM) for a research and modelling project on the estimation of freight transport costs.

The documents describe in detail what bidders must submit and which minimum qualification requirements apply.

Such as: bidders must use the provided forms (Angebotsvordruck, Unternehmensfragebogen, Referenzvordruck, Mitarbeiterqualifikationsprofil, Drittunternehmenseinsatz/Bietergemeinschaftserklärung, ggf. Eigenerklärungen zu Barrierefreiheit und LkSG).

They must prove professional authorization by register entry or equivalent, declare overall turnover and turnover in the contract’s field, and confirm existence/cover sums of professional or business liability insurance via the Unternehmensfragebogen.

Exclusion grounds under §§ 123, 124 GWB must be declared not to apply, by each bidder and each member of a bidding consortium, and – in cases of Eignungsleihe or use of subcontractors – by the third-party companies using the provided declarations.

The scope of the contract is outlined mainly in the Bewerbungsbedingungen (section A) and the Leistungsbeschreibung.

Such as: the contractor must develop statistical functions to estimate freight transport costs for road, rail, inland waterways, maritime shipping and multimodal transport in Germany, and provide a valid monthly data basis for cost components from January 2020 onwards.

The work includes validation of results and a conceptual assessment for extending the functions.

All software must be open-source and free of third‑party rights; the work must be reproducible, and BALM must get full usage rights to models, data, code and associated results, with the Nutzungsrechte forming a separate price item.

Deliverables (data, open‑source model, end report) must be handed over by end of November 2027 at BALM’s site in Cologne (Werderstraße 34), with a subsequent in‑person presentation; only once models, scripts, data and texts run smoothly at BALM are they considered delivered and can final quality checks begin.

Certain tasks – specifically the creation of the core transport cost estimation model – are subject to a (partial) self-performance obligation by the contractor or a named member of a bidding consortium.

Award criteria and weighting are set out in section E of the Bewerbungsbedingungen and in a detailed Bewertungsmatrix.

Show all 29 statements

Such as: the sole award criterion is “quality” weighted at 100%; price has no explicit scoring but is checked for abnormal low pricing under § 44 UVgO.

The maximum total score is 1,550 points, divided into: Teilleistung 1 (Concept and data basis: minimum 280, up to 400 max points plus 210 additional), Teilleistung 2 (Development of cost functions: minimum 120, up to 340 max plus 380 additional), Teilleistung 3 (Communication and documentation: minimum 50, up to 100), and “Personal” (no minimum, up to 120 additional points).

Numerous items are defined as Mindestkriterien; failure to meet any minimum requirement (either on suitability or on the service concept) leads to exclusion.

Qualitative scoring is applied, for example in gradations (not/partly/mostly/fully met) for aspects such as differentiation of goods groups and drive types, data access and data preparation, regional differentiation or pre‑2020 cost estimation.

Preferred companies (e.g. workshops for persons with disabilities) may receive a bonus in price evaluation according to WFB‑Richtlinie, although the main scoring is quality‑based.

Risks and special conditions for bidders are also detailed.

Such as: the tender is a national public procedure without negotiations; bids are binding until the end of the stated bid validity (Bindefrist).

No cost reimbursement is granted for bid preparation, sample work or presentations.

Strict formal requirements apply: submission via the Federal transport administration e‑procurement platform, in German, with specified electronic signatures (simple for forms, at least advanced or qualified for the main offer letter); late bids are excluded unless the bidder proves no fault.

The authority has set that generally no documents will be requested subsequently (§ 41 UVgO), so missing mandatory documents lead to exclusion.

There is a broad confidentiality obligation and a formal Rügepflicht: any ambiguities or legal issues in the documents must be raised in writing by the offer deadline, otherwise the bidder bears the risk and cannot rely on them later.

Contractually, there are penalties and damages provisions: contractual penalties for delay may be imposed, capped at 5% of total contract value, and an alternative lump‑sum damages clause (5% of delayed portion) may be used, subject to proof of higher or lower actual damage.

General terms and conditions of the contractor are excluded, German law applies, and the exclusive venue is Cologne.

Finally, the documents themselves resolve potential contradictions and establish which statement prevails.

Such as: the contract conditions set a hierarchy of documents: (a) contractual conditions, (b) the Leistungsbeschreibung at the time of award, (c) bidder questions and answers, (d) VOL/B, and (e) the contractor’s offer.

In case of conflicts, the higher‑ranked document governs.

The Bewerbungsbedingungen repeat that questions and answers provided via the e‑procurement platform become binding parts of the tender documents.

Tactics

When contracts were awarded in this country and sector, there was usually a single bid in the end. A solid bid has a real chance here. (Based on 3,769 completed awards — not a statement about this procedure.)

This procedure allows 28 days between publication and deadline — typical in this country is 32 (median of 20,496 procedures). Much tighter than usual: the first week counts.

The deadline falls on a Monday — your last full working day is the Friday before. Have evidence and guarantees together by Thursday.

Foreign bidders

In Germany · R&D services, 161 contracts went to foreign companies over the last 3 years (of 4,002 recorded awards) — mostly from Netherlands, Italy, Spain.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
