Contract procedure for carpentry BA 2 – City of Kaufbeuren (Germany, EU-VOB/A)
The present procurement package concerns an EU-wide procurement procedure pursuant to Section 2 VOB/A of the City of Kaufbeuren (Germany) for carpentry work BA 2 in the context of the energy renovation of the Konradin Primary School and its expansion by four classrooms.
The documents are based on Bavarian VHB forms and refer several times to EU law (GWB, EU-VOB/A) and to requirements within the European Union, such as technical evidence and references.
The geographical focus is clearly on Germany (Stadt Kaufbeuren, Vergabekammer Südbayern, Government of Upper Bavaria), while the perspective under public procurement law lies within the framework of the EU VOB/A and the EU directives.
With regard to the documents to be submitted, it is stipulated that the tender must include, in particular, the tender letter (form 213.H), the completed specifications/performance programme, form 221 or 222 for price determination, the self-declaration of suitability (form 124) or alternatively an EEE, form 127 (declaration of reference to Russia), form 248 (wood products), if applicable 2481 (area-owned plants), 2491 (child labour) and, if applicable, 233 (subcontractor services), 234 (tender association), 235 (services provided by other companies) and 2493 (measles protection).
In addition, according to the TED Notice and Form 216, numerous proofs of suitability must be provided upon separate request, such as: Proof of entry in the professional/commercial or trade register, certificates of safety issued by the social security fund, tax office and professional association, proof of professional/business liability insurance (at least €3 million personal injury, €1 million property/wealth damage), turnover for the last three financial years with an indication of the own contribution, the number of employees for the last three years and at least three comparable references for the last five years (form 444).
Pre-qualified entities can demonstrate suitability through a PQ number; non-prequalified persons must use Form 124, including the aforementioned contents.
The documents contain precise information on the scope of services and on the time and location of the work: This is carpentry work BA 2 at Barbarossastraße 29-31 in 87600 Kaufbeuren (NUTS DE272).
The announcement gives examples of approximately 630 m2 of non-load-bearing façade elements, 220 m2 of window openings, around 150 m3 of cellulose blow-in insulation, 680 m2 of windproof films, 680 m2 of groove and spring formwork with substructure, 150 m of plinth protection sheet, 200 m of attic sheeting and 51 m of downpipes.
A site visit is also strongly recommended, which is possible after registration with the contracting authority during school hours.
As regards the award criteria and their weighting, the notice clarifies that price is the only award criterion; There are no other criteria.
This is stated on the one hand in form 211 EU (award criterion ‘price’, value sum from recalculated tender sum incl. discounts, if applicable wage slip clause, maintenance) and on the other hand explicitly in the TED notice (5.1.10: ‘Price is the only award criterion’).
Show all 18 statements
Although Form 216 contains, by default, a section entitled ‘Documents relating to the award criteria’ (acceleration scheme, construction schedule), the contract notice clearly states that only the tender price is decisive in the specific procedure; therefore, in case of doubt, the information in the notice takes precedence and an acceleration rule as an award criterion does not in fact apply here.
Variants/ancillary tenders are not permitted according to the notice (‘Variants: Not allowed’ and in 211 EU: side offers are not allowed); several main tenders are listed in the contract notice (‘Tenderers may submit more than one tender: Not allowed’) also excluded, although the standard form 211 EU provides for the option ‘permitted’ – here again the notice is relevant.
Questions about the procurement documents can be asked until 11.11.2026, 09:30.
With regard to possible inconsistencies or corrections within the documents, it is essential that the TED notice is explicitly mentioned as the ‘source of the selection criteria’ and for the conditions of the award of the contract.
Where standard texts of the VHB forms contain general options (such as ‘several main offers accepted’, ‘additional offers accepted’, ‘guarantee waived/to be provided’, ‘further award criteria’), the contract notice clarifies and specifies these options for the specific contract: only one lot (carpentry work BA 2), no variants/side offers, no multiple offers, price as the only criterion, electronic submission mandatory.
The notice also clarifies the time limits for legal remedies pursuant to § 160, § 134 GWB and the obligations to complain.
Only the contracting authority's tender documents are binding. As of: 28/10/2026
