Tender documents at a glance

The essentials of the tender documents, read in seconds. For your bid, the original documents count.

Powered by eBriefing – EU language technology. Friedrich is an independent service, not an EU offering.

The input text concerns an EU-wide procurement procedure for construction services (dry construction works) in the district court of Kiel, organised by the building management Schleswig-Holstein AöR. It is based on the German procurement and contract regulations for construction services (VOB/A, Section 2) and the national standardised VHB forms. The procedure and all legal references are clearly described from the perspective of Germany; other countries are only addressed via TED/NUTS codes, without their own legal positions.

The text specifies in detail which documents tenderers must submit with the tender and which documents must be submitted only on separate request. For example, the tender letter (Form 213) including the completed list of services with prices is mandatory, as is, depending on the case, the self-declaration of suitability (Form 124) or the indication of a PQ number and, if applicable, annexes such as 234 (community of bidders), 235 (capacity of other companies) or Annex 3 to the Russia reference. Upon separate request, proof of reference, trade registration/trade card/IHK registration, safety certificates from the social security fund, tax office and professional association as well as exemption certificate according to § 48b EStG must be submitted. In addition, the selection criteria are specified, such as specific annual turnover in the last three years, at least three years of business activity, references to comparable services in the last five years, staff numbers (management staff and average workforce) and entry in relevant registers.

Show the full summary (6 paragraphs)

For the scope of services, the text describes in detail the location, scope and period of the construction work. For example, drywall works in the listed building of the district court of Kiel (Deliusstraße 22, NUTS DEF02, Germany) are advertised, with works in the EC and 3.-6. Upper floor, including drywall, door openings and accompanying painting and electrical work. Specific quantities include e.g. approx. 250 m2 dust protection walls, 300 m2 floor protection, various overlays, acoustic wall coverings, platforms, ceiling coverings, GK ceilings and grid ceilings. The construction period is divided into three construction phases from October 2026 to June 2029, with a contractual start of execution according to the construction schedule and completion deadline of 30.06.2029. Particular organisational framework conditions – such as construction access, missing vehicle parking spaces, limited storage space, missing day accommodation, the noise protection window 9:00-14:00, as well as requirements for site regulations, construction diary (form 411) and digital photo documentation – are an integral part of the contract.

With regard to award criteria and evaluation, it is stated that the award is made exclusively on the basis of the price criterion; the value is calculated on the basis of the recalculated offer amount, taking into account discounts, pay slip clause reimbursement amounts and, where applicable, maintenance offers. Several main offers are allowed, while variants/side offers are only allowed if explicitly allowed; in this procedure, variants are not permitted and ancillary offers are only possible under certain conditions, whereby ancillary offers with waiver of material price transmission are excluded. A 15% bonus is also provided for the value of workshops for the disabled, provided that proof of this is provided with the offer. Tenders must be submitted electronically in German via the tendering platform (iTWO tender / ava-sign, .p7m file).

With regard to risks and special conditions, the text regulates, for example, contractual penalties for exceeding deadlines (§ 11 VOB/B), securities (§ 17 VOB/B), material price guidance, waste disposal (form 241), data processing and special requirements for hot work (licence certificate). For example, a contract performance guarantee of 5% of the order amount (including VAT, excluding supplements) is provided if the order amount is €250,000 net, and a security for claims for defects of 3% of the advance payments at the time of acceptance; Guarantees are to be provided in predetermined forms. The contractor must complete a permit for hot work and start the work only after express permission. Further risks arise from strict requirements for construction site regulations, cleaning and disposal obligations, the prohibition of own fee-paying construction cleaning hours and the noise protection corridor. The period of validity of the tender shall be 60 days; Questions must be submitted exclusively via the platform by 11/09/2026, 11:59 p.m.; there is no public opening of tenders and no explicit site visit is described, but there is a high need for coordination with the Works Management.

For contradictions or corrections within the documents, the texts contain some clarifications as to which statements apply in case of doubt. For example, the long version of the price schedule is explicitly ‘solely binding’; self-produced abstracts are only permitted informally. In addition, the tender letter states that the tenderer accepts changes to the procurement documents received as part of the tender, so that corrections published later replace the original statements. In the area of technical specifications, it is clarified that even without the addition of ‘or equivalent’, equivalent specifications are always allowed, whereby in the absence of product information, the proposed product is automatically deemed to be offered. Potential ambiguities must be challenged in writing by companies prior to the submission of tenders; In the absence of a complaint within the prescribed period, the preclusions for review under Paragraph 160 of the GWB apply, which means that the version published in the later version of the procurement documents is authoritative.
