Vergabeverfahren Elektro BA 2–2027 – Energetische Sanierung Konradin-Grundschule Kaufbeuren
The input text concerns an EU-wide public tender for construction works (Elektroinstallation) in Germany, specifically issued by the Stadt Kaufbeuren under the German procurement rules (EU-VOB/A and GWB).
It is clearly written from the point of view of a German contracting authority operating within the European Union legal framework, but it also references other EU/EFTA countries (for technical proofs or certificates) and mentions Turkey and EFTA states as acceptable sources for certain technical evidence.
Thus, the regulatory context is German (VHB Bayern form set, VOB/B, VOB/A, GWB) within the broader EU public procurement regime.
The general background is that this is an open procedure (“offenes Verfahren”) for the lot “Elektro BA 2 – 2027” within the project “Energetische Sanierung Konradin-Grundschule und Erweiterung um 4 Klassenräume” at Barbarossastraße 29–31 in 87600 Kaufbeuren.
The tender documentation relies extensively on standardized Bavarian construction procurement forms (VHB Bayern), including the Aufforderung zur Angebotsabgabe (Form 211 EU), Teilnahmebedingungen (212EU), Eigenerklärung zur Eignung (124), Angebotsformular (213.H), Verzeichnis der Unterlagen (216) and Besondere Vertragsbedingungen (214.H), supplemented by the EU contract notice (TED extract).
The works must be carried out between 01.03.2027 and 27.08.2027, and the tender is fully electronic via the iTWO tender / ava-sign platform.
Regarding what the bidder must submit and minimum qualification requirements, the documents specify that with the offer the bidder must use the provided forms and in particular submit: the Angebotsschreiben 213.H, the priced Leistungsverzeichnis/Leistungsprogramm, Form 124 “Eigenerklärung zur Eignung” (or alternatively an EEE), Form 127 (Erklärung Bezug Russland), Form 221 or 222 (Angaben zur Preisermittlung), and—such as—in case of joint bids, Form 234 (Erklärung Bieter-/Arbeitsgemeinschaft), in case of subcontracts, Form 233 (Nachunternehmerleistungen) and 235 (Verzeichnis der Leistungen/Kapazitäten anderer Unternehmen), plus the declarations on wood products (248), native plants (2481), and child labour (2491), and the Masernschutz-Erklärung (2493) where required.
Minimum qualification elements, to be proven initially via Form 124/EEE and then on request within 6 calendar days, include: proof of registration in the relevant Berufs-/Gewerbe-/Handelsregister, proof of social insurance and the tarifliche Sozialkasse (if applicable), membership and qualified Unbedenklichkeitsbescheinigung of the Berufsgenossenschaft, Bescheinigung in Steuersachen and a current Freistellungsbescheinigung (§ 48b EStG), evidence of payment of taxes and social contributions, statements on insolvency and liquidation status and absence (or self-cleaning) of exclusion grounds under § 6e EU VOB/A and §§ 123–126 GWB, turnover for the last three completed financial years for comparable works (including share of own performance), at least three comparable references over the last five calendar years in the format of FB 444, and average staff numbers over the last three years broken down by wage groups and technical management.
In addition, the bidder must provide proof of a Berufs- oder Betriebshaftpflichtversicherung of at least €3,000,000 for personal injury and €1,000,000 for property/financial damage, and product data sheets, certificates and manufacturer proofs for the offered products; prequalified companies may instead give their PQ number, supplemented by any tender-specific single proofs.
Concerning the scope of the contract (what, how much, where, when), the TED notice describes the lot as electrical installation works (CPV 45311000 / 45311200) comprising, such as, 123 luminaires, 93 KNX components, and 880 metres of cables and lines.
The place of performance is explicitly the Konradin-Grundschule, Barbarossastraße 29–31, 87600 Kaufbeuren (Germany, NUTS DE272).

The planned execution period runs from 01.03.2027 (start of works) to 27.08.2027 (end date), and the Besondere Vertragsbedingungen 214.H specify that these are Ausführungsfristen and Vertragsfristen under § 5 VOB/B, with detailed contractual dates or a bauzeitenplan (bar chart schedule) governing start, completion and intermediate milestones.
Although Form 216 generically refers to “Unterlagen zu den Zuschlagskriterien” like a bauzeitenplan and a bidder-defined Bauzeitende (Beschleunigungsregelung), in this specific tender the contract notice clearly states that price alone is the award criterion, which implicitly limits any “Beschleunigungsregelung” role to contractual performance rather than award scoring.
On award criteria and weighting, the documents contain both the generic VHB template text (“Mehrere Zuschlagskriterien gemäß Formblatt 227.H – Gewichtung der Zuschlagskriterien”) and the concrete specification from the EU notice.
The TED extract explicitly states that the only award criterion is price (“Der Preis ist das einzige Zuschlagskriterium”), repeated and clarified that no further weighting is applied and price alone determines the economically most advantageous tender.
Furthermore, variants/Nebenangebote and multiple main offers are explicitly not allowed in the contract notice (variants: not zulässig; several offers: not zulässig), and Form 211 EU is filled accordingly (Nebenangebote are not admitted under point 6.1).
In terms of risks and special conditions, the Besondere Vertragsbedingungen 214.H and Teilnahmebedingungen 212EU define several important contractual and procedural risks.
The bidder is bound to their offer until the end of the Bindefrist stated in 211 EU; offers must be submitted electronically in German via the iTWO tender portal, using ava-sign, and by the deadline 10.11.2026, 09:30, with questions to be raised by 04.11.2026, 09:30 through the platform; missed deadlines for rüges (complaints) and review applications are governed by § 160(3) GWB and §§ 134, 160 GWB, as detailed in the TED text.
Subcontracting and Eignungsleihe carry specific risks: such as, all intended subcontracts and borrowed capacities must be indicated in Form 235, and on request the bidder must provide Form 236 “Verpflichtungserklärung anderer Unternehmen”, including a joint liability statement if financial capacities are borrowed.
If exclusion grounds or lack of qualification are found for a named other company, the bidder must replace it within a set time limit.
Contractual penalties (Vertragsstrafen) under § 11 VOB/B are significant: for each working day of delay beyond contractual deadlines (Einzelfristen or completion), a contractual penalty of 0.1% of the objectively justified Abrechnungssumme (excluding VAT) is due, capped at 5% of that sum, with penalties for missed intermediate deadlines offset against penalties for final completion.
Security (guarantees) can be either waived or imposed depending on contract value: the template states that performance security under § 17 VOB/B is waived unless the net contract sum exceeds €250,000, in which case a specified percentage of the gross contract sum must be provided; similarly, security for defects may be waived or set as a percentage of the total interim payments at acceptance.
If security is required, the contractor must use the prescribed guarantee forms (Vertragserfüllungsbürgschaft, Mängelansprüchebürgschaft, Abschlags-/Vorauszahlungsbürgschaft).
Additional special conditions include: prohibition of chemical-synthetic plant protection, restricted advertising on site, extended time for final payment under § 16 VOB/B, and a clause allowing the client, after early termination, to reassign remaining works without a new tender, provided the new contractor’s remuneration is not unreasonably high—costs claimed from the previous contractor cannot be challenged on the basis that no new procurement procedure was run.
There is also a significant anti-cartel clause in 213.H imposing a flat 5% damages of the contract sum if unlawful collusive arrangements are proven.
As to contradictions or corrections within the documents, the main tension stems from standard form texts versus specific tender customisation.
For example, such as, Form 216 talks about “Unterlagen zu den Zuschlagskriterien” including Bauzeitenplan and Beschleunigungsregelung, and 211 EU mentions “Mehrere Zuschlagskriterien gemäß Formblatt 227.H” as a generic option, but the TED contract notice and section 5.1.10 clearly fix “Preis” as the only award criterion, with no other weighting; therefore, where templates suggest multiple criteria, this is not operative for this tender—the specific notice prevails.
Another apparent inconsistency is between 211 EU page 5, which allows both electronic and written submission, and the TED notice 5.1.12, which states “Elektronische Einreichung: Erforderlich” and uses the RIB/iTWO portal as the sole submission channel; here, the more specific and later-stated condition in the EU notice (and in 2492 Online-Vergaben) governs, making electronic submission mandatory.
Likewise, generic references in 212EU and 216 to vehicle restraint systems (Fahrzeug-Rückhaltesysteme), MVAS qualifications, Fahrbahnmarkierungsfachkräfte, and Schutzplanken-Montagefachmann are form-level text not practically relevant to an electrical installation lot—unless the Leistungsverzeichnis explicitly calls for such works; absent that, the specific scope (Electro CPV codes, quantities of cables, luminaires, KNX components) defines the applicable technical proofs.
