… subject-matter of the contract – Annex 1 to the ToR. 4. The requirements for the performance of the contract are set out in the draft contractual provisions in Annex 9 to the ToR. 5. Information on the use of equivalent products, materials and technologies: 1) If in the description of the subject of the contract the Ordering Party refers to standards, European technical assessments, technical specifications and other technical reference systems referred to in Art. 1 point 2 and paras. 3 of the Act, it is required to indicate that it allows solutions equivalent to those described, and such a reference is accompanied by words or ‘equivalent’. Any proper names that may have been used in the description of the subject of the contract should be interpreted as definitions of standards, and not as names of specific solutions applicable in the project. 2) The Ordering Party stipulates that wherever trade marks, patents or the origin of devices or materials are indicated in the content of the Description of the subject of the contract – Annex 1 to the ToR, they should be treated only as proposals. The Contracting Authority accepts the use of methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject of the contract, which means that the Contractor may propose in the tender the use of market equivalents with characteristics not inferior to those indicated by the Contracting Authority. The provisions used in this way are possible only in situations where the contracting authority was not able to describe the subject of the contract with sufficiently precise terms - in these cases the wording should always be adopted - or the equivalent . The parameters indicated in the procurement documents shall specify the minimum technical, operational and functional conditions to be met by the subject-matter of the contract and the materials, products and equivalent solutions used by the Contractor must be at least: - of the same strength and durability, of the same level of aesthetics (products), - of the technical parameters described in the tender documentation, - fulfil the same functions and requirements, - have appropriate documents allowing for use (statutes, certificates and technical approvals). 6. Guarantee: a. The Contractor shall provide a guarantee for the delivered vehicle not less than 24 months from the date on which the acceptance protocol is signed by the authorised persons without defects or defects. If the manufacturer's guarantee is shorter than the minimum required by the Ordering Party, the guarantee granted by the Contractor will be binding on the Parties. b. The maximum scoring warranty period is 60 months. In the event that the manufacturer's warranty is longer than the warranty provided by the Contractor, the manufacturer's warranty shall apply. c. It is agreed that the warranty period and warranty for defects are equal. 7. Means of proof in question: 7.1) By the deadline for submitting tenders, the Contracting Authority requires the Contractor to submit the means of proof in question – Annex 10 to the ToR confirming that the vehicle offered by the Contractor meets the requirements specified by the Contracting Authority in the Description of the Subject of the Contract – Annex 1 to the ToR. 7.2) The Contractor is obliged to submit requirements
