… regulations, safety standards and minimum technical parameters specified in Annex 9 to the SWZ. d) The contractor should be the manufacturer or authorized representative of the manufacturer of the equipment offered; e) Stationary and mobile authorised service of the Contractor within 200 km from the seat of the Ordering Party. f) Training on basic service for two operators of the Ordering Party at the seat of the Ordering Party. g) The Contractor is responsible for the entire order, including the course and timely execution, quality, compliance with technical conditions, quality and applicable law. h) The backhoe loader supplied must be brand new, unused, undamaged, complete, manufactured in 2026 and unencumbered by the rights of third parties. i) The Contractor ensures the legal origin of the machine and the ability to perform warranty and service obligations in accordance with the offer, OPZ and contract. j) The Contractor is responsible for securing the machine and equipment for the duration of transport, so as to prevent their damage or deterioration. k) The Contractor shall provide transport, at its own expense, unloading, commissioning and handing over the machine at the place indicated by the Ordering Party and ordering the place of delivery. l) Whenever the description of the subject of the contract includes indications relating to a specific (brand, trademark, manufacturer, supplier, materials or standards referred to in Art. 1-3 PPL) means that the Ordering Party used the above terms as examples and auxiliary. The contracting authority accepts the offer of materials or solutions ‘equivalent in terms of technical, performance and operational parameters, provided that they guarantee the delivery of supplies in accordance with the tender specifications and ensure that parameters not inferior to those assumed in the documents of this procedure are obtained. (m) The contracting authority informs that the parameters described in Annex 9 to the tender specifications should not be identified with a single manufacturer or model. The indicated requirements are minimum requirements, taking into account the clearly stated tolerances and principles of equivalence. n) The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. If any trademarks appeared in the description of the subject of the contract, the Ordering Party used them only illustratively.
