… are required for the delivered subject of the contract, the Contractor is obliged to provide them as part of the remuneration specified in the tender. 3.3. The contractor must offer the performance of the subject-matter of the contract in accordance with the requirements of the contracting authority set out in the tender specifications and annexes and cover the entire scope of the subject-matter of the contract. 3.4. All the requirements set out in Annex 1A to the ToR – Description of the subject matter of the contract/contract are minimum requirements and their fulfilment is mandatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the offer pursuant to Art. 1 point 5 of the Public Procurement Act, as incompatible with the terms of the contract. 3.5. The subject matter of the contract must comply with the requirements applicable to it set out in Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council, and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC (Official Journal L 119, p. Urz. L 135, 23.5.2023, p. 1, as amended). 3.6. The Contractor shall deliver the subject of the contract new, unused, non-refabricated, non-remanufactured, non-exposed, free from physical and legal defects, complete and in accordance with the requirements set out in the CIP. 3.7. In cases where trade marks, patents, origin, source or a specific process characterising specific products or services would be indicated in the description of the subject-matter of the contract, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and intelligible manner and this is justified by the specific nature of the subject-matter of the contract. In such situations, any use of the above indications should be read with the words ‘or equivalent’. The contracting authority shall indicate in the description of the subject-matter of the contract the criteria used to assess equivalence. 4. Warranty 4.1. The Contractor shall provide twenty-four [24] months guarantee for the subject-matter of the contract. 4.2. The warranty period indicated in point. 4.1. is the minimum period. The contractor may include in its tender a longer guarantee period for the subject-matter of the contract offered, but no longer than sixty [60] months. Point. 19.2.2. The CDS shall apply. 4.3. The warranty period for the subject of the order is counted from the date of delivery of the subject of the order (confirmed by the acceptance protocol). 5.1. The deadline for completing the subject of the contract is fifteen [15] working days from the date of conclusion of the contract. 5.2. The date of completion of the subject of the contract indicated in point. 5.1. is the maximum term for the performance of the subject of the contract.
