The Contractor is obliged to perform the contract on the terms and conditions set out in the tender specifications, the description of the subject of the contract, the breakdown of unit prices together with the list of works, the documents relevant to the lot and the draft provisions of the contract. 5. Throughout the performance of the contract, the Contractor shall provide the staff, equipment, tools, means of transport, materials and other resources necessary for the timely and proper performance of the services. The Contractor shall be responsible for the organisation of the works, the safety of their performance, the maintenance of order and the immediate disposal of waste generated in connection with the performance of the contract, in accordance with the contract documents and the applicable regulations. 6. The Contracting Authority shall require that persons carrying out all physical work related to the performance of the work listed in the unit price schedule together with the list of work be employed by the Contractor or a subcontractor on the basis of an employment relationship within the meaning of Article 22(1) of the Labour Code. The method of documenting employment, the contracting authority's control rights and penalties for non-compliance with this requirement are specified in the draft provisions of the contracts. 2. 1. The subject of the contract in Lot 2 – District II – Prawobrzeże Warszów/Ognica – greenery – is the maintenance of infrastructure, order and greenery in the areas covered by that Lot, as part of the task entitled ‘Maintenance of green areas in the Municipality of Świnoujście divided into: Chopin Park, District II Prawobrzeże Warszów/Ognica, District II Prawobrzeże Przytór/Karsibór’. 2. The scope of services includes, in particular, the care of greenery in accordance with the principles of horticultural art, ongoing maintenance of plantings of annual plants, maintaining cleanliness and order, maintaining the surface and elements of small architecture, performing seasonal work, including work related to the winter period, exercising ongoing supervision over the entrusted property and performing intervention works and other accompanying works indicated in the procurement documents. 3.
