… (Journal of Laws 2026, item 468 of 2026.04.07, as amended); 4) of the Act of 30 August 2002 on Proceedings before Administrative Courts (Journal of Laws of 2026, item 143 i.e. of 2026.02.09). 3. The subject of the contract should be performed in accordance with the principles set out in the generally applicable provisions of law, in particular the Act of 23 November 2012. Postal law (Journal of Laws 2026, item 558 of 2026.04.23, as amended). 4. The scope of the contract includes: 1) postal services in domestic trade for letters weighing up to 2000 g, parcels not being courier services up to 10 kg and foreign parcels weighing up to 2000 g in terms of their reception, transport and delivery, 2) delivery of returns of parcels described in point. 1) not delivered, after exhausting all the possibilities of their delivery or delivery to the recipient and returning the confirmations of receipt to the seat of the Ordering Party. 5. A detailed description of the subject-matter of the contract is set out in Annex 9 to the ToR. 6. The quantities given in Annex 2 to the tender specifications - price form - relating to the estimated quantities of consignments/returns/services, were determined on the basis of data from 2024 to 2025 in order to calculate the value of the offer and compare offers, and are not quantities obliging the Ordering Party, and do not constitute an obligation on the part of the Ordering Party to send consignments in the quantities specified. Specific types and quantities of individual shipments and returns as part of the services provided may change depending on the needs of the Ordering Party. The Contractor shall have no claim against the Ordering Party in the event that the estimated quantities of consignments/returns/services (as specified in Annex 2 to the tender specifications) are not fully used by the end date of the contract. 7. The Ordering Party does not divide the order into lots, thus the Ordering Party does not allow the submission of partial tenders. 8. Reasons for not splitting the contract into lots: The contracting authority, after analysing the scope and size of the contract, as well as the contractors who take part in such contracts (social services and the need to register with postal operators), considered that splitting the contract would risk excessive technical difficulties and excessive costs of performing the contract, and the need to coordinate the activities of various contractors implementing individual parts of the contract could seriously jeopardise the proper performance of the contract. The subject of the contract constitutes an indivisible whole and it is advisable that it be performed by a single Contractor. 9. The Contractor is obliged to perform the order on the terms and conditions described in the model contract constituting Annex 8 to the ToR. 10.
