… family help home and directly providing living and care services in accordance with the rules laid down in the provisions issued on the basis of Art. 3 of this law. A natural person should be understood as both a natural person who does not conduct business activity and a natural person who conducts business activity in his own name, provided that he meets the requirements arising from the Social Assistance Act, regulations and procurement documents. The Contractor will be obliged to personally run the Family Relief House, directly provide living and care services and reside in the building in which the Family Relief House is run, throughout the entire period of the contract. The Contractor may use the assistance of other persons to the extent permitted by law, but it is not permissible to entrust a third party with all the responsibilities associated with running the house. 3. The Family Relief Home is intended for no less than 3 and no more than 8 adults living together, requiring support in the form of 24-hour living and care services due to age or disability. The Ordering Party declares that, according to its documentation, the building and its equipment have been adapted to run a Family Assistance House and meet the requirements set out in the Regulation of the Minister of Family, Labour and Social Policy of 27 July 2024 on family assistance homes. Before concluding the contract, the Contractor will be given the opportunity to inspect the building and familiarise himself with the documentation concerning its technical condition and equipment. The building is after a major renovation, all rooms have been furnished and equipped with equipment and devices necessary for the proper functioning of the House. The contractor bears the costs of the day-to-day operation of the building, in particular the costs of electricity, gas, water, sewage disposal, heating, waste collection, telecommunications services and minor repairs charged to the tenant. The Contracting Authority, as the owner of the building, shall bear the costs of repairs and refurbishments concerning the construction of the building, installation and elements of its permanent equipment, unless the need to perform them results from an act or omission of the Contractor. During the term of the warranty or guarantee, the rights under this title shall be used first. The major renovation of the premises in which the Family Relief House will be run was completed on 31 December 2023. The renovation works are covered by a 5-year warranty. 4. The subject-matter of the contract shall be: 1) the personal running of the Family Relief Home and direct care of residents by the Contractor, whereby the Contractor may use the help of other persons, hereinafter referred to as "assistants", in accordance with § 3 sec. 3-6 of the Family Relief Homes Regulation and the employment requirements set out in the EWS. The number of helpers should be adapted to the individual needs and capacities of the residents, including the obligation to ensure the presence of the caregiver at night. Contractor
