1. The subject of the contract is the delivery of a multi-purpose tractor 95-105 hp, specified in detail in the description of the subject of the contract (constituting Annex 1 to the tender specification), along with its installation, commissioning, training of the Ordering Party's staff and periodic inspections during the warranty period. 2. … Party with a quality guarantee for the subject of the contract for a period of at least 5 years from the date of signing the acceptance protocol. 5. The Contractor, within the scope of the Contract, is also obliged to perform inspections and maintenance of the equipment in accordance with its specifications and manufacturer's recommendations during the warranty period, with a frequency not less frequent than recommended by the manufacturer. The contractor is also obliged to provide all consumables needed to perform inspections and maintenance. 6. The detailed scope of the subject-matter of the contract is specified in the Description of the subject-matter of the contract, hereinafter referred to as ‘OPZ’, constituting Annex 1 to the ToR. 7. The contracting authority shall accept equivalent solutions where reference is made in the subject-matter of the contract to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(b) CTMR. 1 point 2 and par. 3 of the Public Procurement Act. 8. Where the names of manufacturers, models, types of equipment, trademarks or other indications identifying a particular solution are indicated, those indications shall specify the required technical, functional and quality standard. The Contracting Authority shall accept equivalent solutions, provided that the Contractor demonstrates that they meet the requirements set out in the CIP, ensure compatibility with the Contracting Authority's system and do not reduce the functionality, security or reliability of the system. 9. An economic operator that has applied equivalent or better solutions must indicate them in its tender and demonstrate equivalence or superiority to the solutions described in the TIP. 10. The burden of proof for proving the equivalence of the offered solutions with the solutions described by indicating an example trademark, patent, origin, source or specific process shall rest with the contractor.
