… origin, source or a specific process characterising specific products or services are indicated in the description of the subject-matter of the contract, this means that the Ordering Party cannot describe the subject-matter of the contract with sufficiently precise terms and this is justified by the specificity of the subject-matter of the contract. In such situations, any indications of trade marks, patents, origin, source or specific process must be read with the words ‘or equivalent’. The Contracting Authority stipulates that all the names of materials (products) which may be given in the ToR or in another document integral to the ToR are not intended to infringe Article 99 of the Public Procurement Act, but are merely intended to clarify the Contracting Authority’s qualitative and technological expectations. This should be understood as defining the required minimum performance, functional and technical parameters or quality standards. Whenever the Contracting Authority refers to any standards, technical assessments, technical specifications and reference systems in the content of this ToR or in its annexes, the Contractor may use standards, technical assessments, technical specifications and reference systems (referred to in Article 101 of the Public Procurement Act) equivalent to them. In addition, replacement products accepted for valuation: - they must fulfil the function they are intended to serve, - they must be compatible with other devices so that the set of devices gives the intended effect, - they must not change the type and scope of construction works. Pursuant to Article 95 of the Public Procurement Act, the contracting authority requires the contractor, subcontractor or sub-contractor to employ, on the basis of an employment relationship, persons carrying out the work covered by the subject matter of the contract, in accordance with the draft provisions of the contract annexed to the tender specification – this applies to persons carrying out: construction, electrical and sanitary works. This requirement does not apply to activities covered by the subject-matter of this contract falling within the scope of the duties of persons performing functions in accordance with Chapter VI. 7 point 7.2(b) of the ITS. The contractor may, in order to confirm compliance with the conditions for participation in the procedure, where appropriate and for a specific contract or part thereof, rely on the technical or professional capacity or financial or economic standing of other entities making resources available, regardless of the legal nature of its legal relations with it under the rules laid down in Articles 118-123 of the Public Procurement Act.
