The detailed scope of the subject of the contract, the description of the requirements of the Ordering Party in terms of implementation and acceptance are specified in the following documents: 1) design documentation (Annex 5a-k to the ToR), 2) bills of quantities (Annex 6a-h to the ToR), 3) OTSC (Annex 7a-b to the ToR), 4) Decision No 576/25 of 24 June 2025 – building permit – Annex 8 to the ToR; 5) design documentation (Annex 9a-e to the ToR), 6) bills of quantities (Annex 10a-b to the ToR), 7) OTSC – general construction and electricity – Annex 11 to the ToR; 8) Decision No 564/25 of 18 June 2025 – building permit – Annex 12 to the ToR; 9) Description of the subject-matter of the contract – locomotive simulator – Annex 13 to the ToR, 10) The draft provisions of the contract (Annex 4 to the ToR). 5.Conditions for the execution of the order. The subject of the contract is to be executed on the basis of the procurement documents. If the Contractor finds that the order documents contain errors or omissions, he shall immediately notify the Ordering Party thereof, 6. The required warranty period for the executed subject of the contract is a minimum of 3 years (in words: three years), counting from the date of signing by the investor's supervision inspector of the Ordering Party and the Contractor a fault-free final acceptance protocol for the works, with the exception of a guarantee for equipment for which manufacturers' factory guarantees are in force, which should be at least 2 years. The contracting authority requires employment by the Contractor or a subcontractor on the basis of an employment contract within the meaning of the Labour Code Act of 26 June 1974 (i.e. OJ Journal of Laws 2025, item 277) in the scope of performance of the contract of persons performing activities falling within the so-called direct costs. Thus, this requirement applies to persons who carry out activities directly related to the execution of works, i.e. so-called manual workers. The requirement shall not apply, inter alia, to persons: construction managers, robots, geodetic service providers, suppliers of building materials. 8. Where a trade mark (brand), manufacturer, supplier, patent, origin, source or specific process has been indicated in construction and architectural designs, technical designs, technical specifications for the execution and acceptance of works, bills of quantities, which characterise products or services provided by a particular Contractor or has been identified as standards, European technical assessments, common technical specifications or other references referred to in Article 101(1)(2) or (2). 3 Acts, Ordering Party Consented
