… will apply only in cases where it is not possible to determine the primary care doctor or the doctor treating the deceased in the last illness. 2) The subject of the contract may be carried out only by an entity with documented professional qualifications and powers necessary to perform it, in accordance with applicable law or an entity with persons meeting the above-mentioned conditions, i.e.: a) has the status of a medical entity referred to in Article 4 of the Act of 15 April 2011 on medical activity (consolidated text: OJ of Laws 2026, item 156, as amended) and will provide 24-hour on-call duty for a doctor who will perform the activities that are the subject of the contract, or b) has the right to practice medicine in Poland, conducts the business activity referred to in Art. 1 and mouth. 2 point 1 of the Act of 15 April 2011 on medical activity (consolidated text: OJ of Laws 2026, item 156, as amended) and will ensure that the activities that are the subject of the contract are carried out during the 24-hour medical on-call time. 2. The Contractor shall be entitled to perform the task himself or by means of suitably qualified persons for whose acts and omissions he is responsible as for his own. 3. The Ordering Party estimates that the monthly number of death cards issued, after determining the cause of death in the situation referred to in §3 of the Regulation of the Minister of Health and Social Welfare of 3 August 1961 on the establishment of death and its cause (Journal of Laws No. Journal of Laws of 1961, item 39 and 202), in people who died in the administrative area of Tarnogórski District in a public or non-public place will average about 30 events. 4. Requirements for the employment of persons on the basis of an employment relationship (Article 95 of the Act): due to the fact that the activities performed by persons in the performance of the contract do not exhaust the concept of employment relationship, the Ordering Party does not provide for the requirement to employ persons on the basis of an employment contract. 5. The detailed scope of the subject-matter of the contract and the description of the contracting authority’s performance requirements are set out in the draft provisions of the contract – Annex 3 to the ToR.
