… of the contract. 5. Lots of the contract: 1. Lot 2 – Specialised CPV thematic workshops: 80000000-4 - Education and training services and 80570000-0 - Personal development training services. 2. Part 7 – Training in coping with CPV aggression: 80340000-9 – Special education services and 85320000-8 – Social services. If the description of the subject of the contract would indicate, in relation to certain materials and devices, trademarks, patents or origin of the Ordering Party, in accordance with Art. 5 of the Act, allows the assembly of equivalent products. All products from specific manufacturers specify the minimum quality parameters and performance characteristics that the goods must meet in order to meet the requirements set by the Ordering Party and constitute only a quality standard of the subject of the contract. By the provision regarding the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in generally available sources, catalogues, manufacturers' websites. Operating with exemplary manufacturer's names is only aimed at clarifying the level of the Ordering Party's expectations in relation to a specific solution. Thus, the use of the names of producers/products/is purely illustrative. The Ordering Party, when describing the subject of the contract, indicating the designation of a specific manufacturer (supplier) or a specific product, simultaneously allows equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thus recognizing each product with the indicated parameters or better. In such a situation, the Ordering Party requires the submission of relevant documents (together with the offer) that authenticate these materials or devices. They will be assessed by the Contracting Authority, which will be the basis for the Contracting Authority’s decision to accept ‘equivalents’. An economic operator relying on equivalent solutions must demonstrate that the solution it offers meets the requirements specified by the contracting authority. In this case, the contractor shall attach to the tender a list of equivalent solutions together with its description or standards. Describing the subject-matter of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1 point 2 and paras. 3, the contracting authority is obliged to indicate that it accepts solutions equivalent to those described, and such reference is accompanied by words or equivalent . 6. In addition, the Ordering Party obliges the Contractor to maintain care for the natural environment by, among others, eliminating the use of single-use items made of plastic, abandoning the use of single-use packaging, bags, nets and bags made of polyolefin plastics, using materials that are recycled or subject to a recycling process, etc. 7. The technical and quality characteristics of the subject of the contract should correspond to the Polish Standards transposing European standards or standards of other member states of the European Economic Area.
