… confirming qualifications / competences / entitlements, 8) handling, calculation, payment and settlement of the training scholarship and fees due, and - if these benefits will be due in accordance with the project documents - handling, payment and settlement of reimbursement of travel costs and costs of caring for a child or a dependent person; the costs of these benefits are covered by the flat-rate price of the offer, 9) provision of a preventive meal, 10) support for a work coach, 11) support for an assistant of a person with a disability, if required, 12) meetings with potential employers, 13) social skills training, 14) NNW insurance, 15) keeping project documentation. 3. A detailed description of the subject of the contract is attached as Annex 9 to the ToR. 4. Reserved contract – Article 94 of the Public Procurement Act The contracting authority, pursuant to Article 94(1) CTMR, 1 of the Public Procurement Act, stipulates that only economic operators with the status of a sheltered employment establishment, social cooperatives and other economic operators whose main purpose or the main purpose of the activity of their organisationally separate entity, which will perform the contract, is the social and professional integration of socially marginalized people belonging to one or more categories referred to in Article 94 par. 1(1) to (10) of the Public Procurement Act Information about the reservation of the contract under Article 94 of the Public Procurement Act must also be included in the contract notice. 5. An economic operator applying for a contract shall meet the requirement that the percentage employment rate of persons falling within one or more of the categories referred to in Article 94(1)(b) and (c) of Regulation (EC) No 1260/1999 is equal to the percentage employment rate of persons falling within one or more of the categories referred to in Article 94(2). Points 1 to 10 of the Public Procurement Act shall not be less than 30% of the persons employed by the contractor al-bo in its organisationally separate entity which will perform the contract. 6. In the case of economic operators jointly applying for the award of a contract, the requirements laid down in paragraph 4 and 5 must be fulfilled separately by each economic operator. The requirements arising from Article 94 of the Public Procurement Act cannot be demonstrated by relying on the resources of the entity providing the resources. Entrusting part of the contract to a subcontractor may not lead to circumvention of the requirements set out in Article 94 of the Public Procurement Act. 7. Confirmation of compliance with the requirements referred to in para. 4 and 5, the Contractor shall submit the documents or declarations referred to in Chapter XXII of the ToR. These documents are not subjective means of proof to confirm the conditions for participation in the proceedings. 8. Requirements for employment on the basis of an employment relationship – Article 95 of the Public Procurement Act Contracting authority, pursuant to Art. 1 of the Public Procurement Act, requires employment by the contractor or sub-contractor on the basis of an employment relationship of persons performing activities during the performance of the contract consisting in ongoing administrative and settlement services for the contract, in particular: a. handling and verification of documents regarding the benefits due to project participants; b. calculating training scholarships and preparing their settlements; c. handling applications and settlements regarding the reimbursement of travel costs and the costs of caring for a child or a dependent person; d. preparing statements of payments
