An economic operator who relies on solutions equivalent to those described by the contracting authority shall prove that the proposed solutions meet the requirements set out in the description of the subject-matter of the contract to an equivalent degree. 3) The Ordering Party informs that where it has described the subject of the contract by indicating the trademarks, patents or origin, source or specific process that characterizes the products delivered by a particular Contractor, which could lead to the preference or elimination of certain Contractors or products, the Ordering Party allows an equivalent solution, provided that they are of no inferior characteristics and quality. The Ordering Party informs that in such a situation, the provisions in question are only examples and constitute an indication for the Contractor of what features should be possessed by the materials used to perform the subject of the contract. The possible use of the manufacturer's name is only exemplary and is only intended to clarify the level of expectations of the Ordering Party in relation to a specific solution. 4) The Contractor who refers to solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the supplies offered by him meet the requirements specified by the Ordering Party to submit relevant documents proving these solutions. 5) A contractor using equivalent certificates or standards must attach them to the tender. By a certificate or equivalent standard, the Ordering Party understands a certificate or a standard analogous to the scope with certificates or standards indicated by name, which confirms compliance with the certification or a standard characterized by features appropriate to the certification or a standard listed by the Ordering Party, issued by an independent entity authorized to certify (if applicable). 6) The Contractor, offering an object equivalent to the one described in the tender specifications and annexes, is obliged to maintain equivalence in terms of performance, functional, overall and quality parameters, defined by the Contracting Authority in the tender specifications and annexes, as equivalence parameters.
