1.1 The subject of the contract is the non-cash purchase of diesel fuel for a tank with a capacity of 5000 l. 1) The Contractor will deliver by his own transport, at his own expense and risk, diesel fuel successively to the needs of the Ordering Party with a frequency ensuring continuity of refuelling to the Ordering Party's Employees. The estimated total amount of diesel is 120,000 litres. Deliveries of diesel fuel to the tank located in Żary at ul. St. John Brother Albert 8, will take place on working days from 7.30 - 15.00 to 72-hours from sending the order by e-mail or by fax (working days), depending on the time of delivery offered in the Offer Form. The Contractor is obliged to notify the Ordering Party of the planned delivery at least 3 hours in advance (notification on working days). … Employer's Employee. 2) At its own expense, the Contractor shall connect, in the presence of the Employer's Employee, to the tank located at the premises of the Employer, in Żary at ul. St. John Brother Albert 8, a distribution system for non-cash refuelling with a refuelling record system that must be legalized and calibrated. The distribution system will be the property of the Contractor and must be adapted to the Customer's tank, i.e. FM 5000 (new designation: BFM 05000DG) Kingspan Environmental Sp. z o.o. Rokietnica. 3) The supplied diesel fuel must comply with its classification, composition and quality requirements provided for in applicable legislation, quality standards and standards. The Ordering Party requires that the supplied diesel fuel meets the requirements for this type of fuel, specified by the Polish Standards and has parameters not worse than those specified in the PN EN 590:2013-12 standard, and quality requirements in accordance with the Regulation of the Minister of Economy of 26 June 2024 on quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended). 4) In case of justified doubts as to the quality of delivered fuel, the Ordering Party, informing the Contractor about this fact, may test fuel samples in a laboratory authorized to perform such tests. If it is found that the fuel does not comply with the Polish Standards, charge the Contractor with all the costs of the test and demand the replacement of the fuel and the payment of the related costs. In the event that the Contractor does not replace fuel of inadequate quality or delivers such fuel again, the Ordering Party has the right to withdraw from this contract for reasons attributable to the Contractor, as well as to charge him with the obligation to pay compensation for improper performance of the contract. 5) The Contractor undertakes to deliver each delivery of diesel fuel to the Ordering Party's tank, provide the Ordering Party with a quality certificate and a waybill issued by the Contractor's warehouse containing the date and time of loading, registration number of the tank supplying fuel. 6) Delivery of diesel fuel may not take place later than within 24 hours from the moment of loading the tanker at the Contractor's warehouse. 1.2. The contracting authority in accordance with Article 108a of the Act of 11 March 2004 on the tax on goods and services (i.e. OJ of Laws 2026, item 1263 as amended) will apply the split payment mechanism when making payments of the amount.
