Where no equivalence criterion is given in the technical documentation, the key technical parameters of the designed equipment shall be taken as the criteria. All names indicating specific manufacturers or specific models are used to determine the minimum quality parameters and performance characteristics that goods must meet in order to meet the requirements set by the Ordering Party. Operation with names is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution and is only of an illustrative/informative nature. 5.In accordance with Art. 4 of the Act in the event that the documentation, i.e. the documents describing the subject-matter of the contract, includes a reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point. 2 and mouth. 3 of the Public Procurement Act, and such terms are not accompanied by the expression ‘or equivalent’, it is the Contracting Authority that allows solutions equivalent to those described in each standard, technical assessment, technical specification, technical reference system. Accordingly, it must be assumed that each standard, technical assessment, technical specification, technical reference system appearing in the description of the subject-matter of the contract is accompanied by the words ‘or equivalent’. 6.According to Art. 5 p. z. p. p. The contractor who refers to equivalent solutions described in these documents is obliged to prove, by attaching to the tender the relevant evidence referred to in Articles 104-107 of the Act p. z. p., that the proposed solutions meet in an equivalent manner the requirements set out in the description of the subject of the contract. 7.Guarantee: The Contractor shall provide at least 24 months of guarantee and warranty for the poles delivered and placed and the works carried out from the date of signing the contract. Maximum warranty period: 60 months. 8.Warranty and warranty period referred to in point. 7 above, is one of the criteria for the evaluation of tenders, which will be evaluated in accordance with Chapter XIX of the Terms of Reference. The Contractor may declare a longer warranty period for the delivered and positioned poles, materials, stating the above in the Offer form - Annex 2 to the tender specification. 9.It is agreed that the warranty period and warranty for defects are equal. Under the warranty and warranty for defects, the Ordering Party requires the removal of defects and defects arising during the warranty period. 10.The contractor is obliged to comply with the minimum requirements for ensuring accessibility for persons with special needs set out in Article 6 of the Act of 19 July 2019 on ensuring accessibility for persons with special needs.
