… offered. In the absence of the required data, the Ordering Party will reject the offer pursuant to Art. 1 point 5. The name of the product offered constitutes the substantive content of the tender, because it serves to identify and specify the subject of the contract offered and the subsequent subject of the contract, i.e. failure by the Contractor to provide the name of the product (the name given by the manufacturer) if the Ordering Party required this name by the provisions of the specification, makes the content of the tender inconsistent with the content of the specification. The offer must not give the possibility of additional searches for its content, it must be unambiguous in order to be able to verify its compliance with the content of the tender specification.
