The works must be carried out in accordance with the documentation, technical specifications for the execution and acceptance of the works, the applicable technical regulations, the rules of technical knowledge and under the conditions laid down in the contract. 5. The Ordering Party reserves that wherever in the content of the Description of the Subject of the Contract, Measurement, Technical Specifications for the execution and acceptance of construction works, constituting a description of the subject of the contract, trademarks, patents or origin, sources or detailed processes that characterize products or services provided by a specific contractor, European standards, technical assessments, technical specifications, technical reference systems referred to in Art. 1 point 2 and lips. 3 of the Public Procurement Act - the Ordering Party allows methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject of the contract. Equivalent to those presented in the description of the subject-matter of the contract shall be understood as made by any manufacturers while maintaining not inferior technical parameters and functional, functional and fully compatible with the technical solutions included in the description of the subject-matter of the contract. 6. The parameters of the standard specify the minimum technical, operational, operational, quality and functional conditions to be met by the subject-matter of the contract. The trademarks, patents, brands or names of the manufacturer or the sources or specific processes indicating origin indicate only the class of the product, method, materials, equipment, systems, technology, etc. 7. The contracting authority also points out that equivalent methods, materials, devices, systems, technologies, etc. may not constitute alternative solutions to the methods, materials, devices, systems, technologies, etc. described in the description of the subject-matter of the contract by means of trademarks, patents, origin, source or a specific process. 8. The Contractor who offers methods, materials, equipment, systems, technologies, etc. equivalent to those described in the description of the subject-matter of the contract must indicate in the Tender Form that he offers equivalent solutions, attach to the tender a list of equivalent solutions and demonstrate this equivalence. Pursuant to paragraph 35 of the Judgment of the Court of Justice of the European Union of 2018-07-12, C-14/17, for this purpose it is required to submit with the offer relevant documents and declarations confirming this equivalence, e.g. catalogue sheets/technical specifications/descriptions, etc. 9. Where the requirements in the description of the subject-matter of the contract refer to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Contracting Authority requires the contractor to present in its tender a list of equivalent solutions and proofs of equivalence in the manner specified in Art. 5 and 6 of the PPL Act. 10. The proofs of equivalence referred to in points 8 and 9 shall constitute the evidence in question and the economic operator shall attach them to the tender.
