… works. 1) The contractor of the works is responsible for the quality of their execution and for their compliance with the design documentation. Measuring works for the purposes of the works and all related costs shall be borne by the Contractor and shall be included in the contract price. 2) The Contractor is fully responsible for meeting the quantitative and qualitative requirements from any source the materials will be sourced. The Contractor shall bear all costs related to the delivery of materials to the construction site. 3) The Contractor is obliged to use only such equipment that will not adversely affect the quality of the works performed. 4) Equipment tailored to the scope of works should meet health and safety requirements. 5) All works should be carried out in accordance with applicable standards, building art, health and safety regulations, fire regulations and environmental protection regulations and recommendations of the Ordering Party 6) The Contractor will carry out marking and securing work sites for the duration of the works at his own expense. 7) A detailed description of the subject-matter of the contract is included in Annex 4 to the FTZ – design documentation, technical specifications for the execution and acceptance of works, drafting of works. 8) Additional information regarding the performance of the contract: The contracting authority reserves that there may be tonnage restrictions – appropriate vehicle loads appearing on the roads for the projected investment. The above should be taken into account when preparing the offer. Difficulties in this respect will not be a basis for changing the price. The Contractor shall be responsible for obtaining the appropriate approval from the public road operator for the carriage of the materials and equipment needed for the performance of the contract. Transport of materials to the site of the works must be carried out by means of transport adapted to the tonnage determined on the access roads to the place where the works are carried out. Other requirements for the performance of the subject-matter of the contract: 1. All materials used to perform the contract must have a release for free circulation and have a declaration of conformity or a certificate of conformity with the Polish Standard or technical approval in the absence of Polish Standards transposing European harmonised standards. 3. During the implementation of the investment, the Contractor shall provide the Ordering Party with the opportunity to check the construction materials that will be used to perform the subject of the contract. 4. The Contractor is obliged to restore to the proper condition and order of the construction site, as well as (if used) roads, real estate, equipment, facilities that the Contractor violated when performing the subject of the contract. As part of the financial statement, the Contractor shall take into account: 1) in the case of using subcontractors, coordinating the works of subcontractors bearing full responsibility for them, 2) carrying out the works taking into account all conditions and orders resulting from mutual agreements and obligations, 3) ensuring the proper condition and order of the place where the works are carried out, and in particular access roads, which the Contractor will violate in order to perform the subject of the contract, 4) repairing any damage from
