… 40 days, the Ordering Party in-forms that in fact the ordered quantities may be smaller. In such cases, the Contractors shall not be entitled to any claims against the Ordering Party. 4. Quantitative demand for the above-mentioned aggregate referred to in point 1 is the estimated (+/-) demand during the contract performance period and is not binding on the Ordering Party. In the event of non-use during the term of the contract of the quantity of goods specified in point. 1 The Contractor shall not be entitled to any claims in this respect. 5. The aggregate should have granulation from 0.1 to 1 mm in accordance with the requirement set out in the Ordinance of the Minister of the Environment of 27.10.2005 on the types and conditions of application of measures that may be used on public roads and streets and squares (Journal of Laws No. U. of 2005. No. 230 item.1960). The contractor undertakes to provide the contracting authority with up-to-date laboratory tests of sand with a granulation of 0.1-1 mm confirming compliance with the requirements of the Minister of the Environment in the field of materials used on public roads in the winter period at the request of the contracting authority and will comply with the requirements set out in the standard: PN-EN 13242+A1:2010, PN-EN 13043:2004 or equivalent. Under the concept of equivalence, the contracting authority understands that aggregates meet the requirements listed in the above-mentioned standard in terms of: Grain Dimension, Grain, Dust Content, Dust Quality, Sand Gauge, Fractional Grain Density, Absorption, Frost Resistance, Shape Gauge, Flatness Gauge, Solar Gorge, Shredding Resistance, Aggregate Abrasion Resistance, Sulfur Content, Sulphur, Organic Pollutants. 7. In accordance with Art. 5 of the Public Procurement Act, an economic operator who relies on equivalent solutions is obliged to demonstrate that the aggregates offered by it meet the requirements of the above-mentioned standard. 8. In order to confirm the proper performance of the contract, the contracting authority reserves the right to weigh a randomly selected car delivering aggregate before unloading and after unloading, and the right to laboratory test any batch of delivered material. In the event of non-compliance of the delivery with the delivery document, the contractor will be obliged to deliver the missing amount of sand within the time limit indicated by the Ordering Party and return to the Ordering Party the costs of weighing and tests carried out. 9. Supply requirements: 1) performance of each part of the subject of the contract will take place depending on the needs of the Ordering Party on the basis of successive, ad hoc and non-cash deliveries. 2) the contractor will deliver the aggregates by its own transport successively in batches, on working days (Monday to Friday), after the order has been placed by the ordering party (in writing, by e-mail, by fax or by phone with subsequent confirmation by e-mail). 3) Together with the delivery of the ordered batch of aggregates, the Contractor will provide the Declaration of Performance issued by the manufacturer of aggregates and a document on the acceptance of aggregates for use in construction, as well as the required attestations and certificates. 4) In case of doubt about the quality of the delivery
