… manufacturers' websites. The use of exemplary names of the manufacturer is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution. Thus, the use of the names of producers / products / is purely illustrative. The Ordering Party, when describing the subject of the contract, indicating the designation of a specific manufacturer (supplier) or a specific product, at the same time allows equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thereby recognising any product with indicated parameters or better. In such a situation, the Ordering Party requires the submission of appropriate documents (together with the offer) authenticating these materials or devices. They will be assessed by the contracting authority, which will be the basis for the contracting authority’s decision to accept ‘equivalents’. The Ordering Party reserves the right to ask the author of the design documentation for an opinion on the materials or devices offered. If the Contractor fails to submit documents on the use of other materials and equipment, this shall be understood as meaning that the materials and equipment proposed in the description of the subject of the contract are included in the calculation of the price of the tender. 4. Describing the subject of the contract in the attached Detailed description of the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Law Act, the Contracting Authority shall allow solutions equivalent to those described, and any such description shall be accompanied by words or equivalent.’ 5. The technical and quality characteristics of the subject of the contract should correspond to the Polish Standards transposing European standards or standards of other Member States of the European Economic Area.
