… materials or equipment. 1) The Ordering Party has made every effort to ensure that the trade name of the company, goods or product is not included in the description of the subject of the order. If the documents making up the description of the subject-matter of the contract indicate the trade name of the company, product or product, it is for information only 2) If there are any indications of trademarks, patents or origin in the description of the subject-matter of the contract, they specify a minimum standard of quality of materials or equipment accepted for valuation. Any materials or devices originating from specific manufacturers are only a quality standard of the subject of the contract. The use of exemplary manufacturer names is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution, quality, technical and functional standards. 3) The Ordering Party, in accordance with Art. 5 PPL allows the Contractor to offer materials and equipment equivalent to those indicated in the documentation - description of the subject of the contract, provided that they ensure that technical parameters are not inferior to those assumed. 4) In the case of offering equivalent material or equipment, the Contractor is obliged to submit with the tender the means of proof in question confirming that the materials and equipment offered meet the requirements of equivalence, i.e.: a list of materials and equipment other than those in the FTZ and their technical characteristics, data sheets or similar documents. 5) The obligation to prove the equivalence of the tender rests with the Contractor, failing which it will be rejected pursuant to Art. 1 point 5 of the PPL. 6) If the Contractor fails to submit the evidence in question or the evidence in question is incomplete, the Contracting Authority shall request the Contractor to submit or supplement it within the prescribed period pursuant to Article 107(2) of the Public Procurement Law. The contracting authority shall request that the contractor indicate in the tender form the parts of the contract which it intends to subcontract and that the contractor provide subcontractor companies, if known. The contracting authority does not reserve the obligation for the contractor to perform the key parts of the works or services contract in person.
