… deliver and bring the complete and assembled (on-site assembly is allowed) subject of the contract (with the parameters specified in the description of the subject of the contract) to the room indicated by the Ordering Party. The subject-matter of the contract (equipment/kit/product) must be complete, i.e. it must have the equipment, functions, solutions, complete wiring necessary to run the equipment, etc. compatible with the device and enabling it to work in the full range of parameters and functionalities. 6. The Contractor shall provide the Contracting Authority with the following documents in accordance with the terms and conditions set out in the draft contract: 6.1. current attestations, required releases for free circulation, certificates/declarations of conformity/safety, standards or other relevant documents, 6.2. instructions for use in Polish or English with translation into Polish (for each equipment/set) – the Ordering Party accepts the possibility of indicating the source of availability of the instructions for use in electronic version, 6.3. warranty cards in Polish (paper version), including guarantees issued by the manufacturer (guarantor's statement), the content of which will include at least the following information: the name and address of the guarantor or his representative, the duration of the guarantee protection, the rights of the Ordering Party in the event of a physical defect, but with priority to the provisions of the contract. 7. The subject of the contract must meet all the requirements of a safe product in accordance with Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council, and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC of 10 May 2023 (OJ L 135, p. 1). The Contractor is obliged to deliver a brand new subject of the contract (in particular unrepaired, non-refabricated, non-exhibition, previously unused, coming from current production and legal distribution channel, efficient, complete (in particular with all components, parts, materials) and compliant with the OPI. 8. In cases where trade marks, patents, origin, source or a specific process characterising specific products or services would be indicated in the description of the subject-matter of the contract, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and intelligible manner and this is justified by the specific nature of the subject-matter of the contract. In such situations, the possible use of the above indications shall be read with the words ‘or equivalent’. The contracting authority shall indicate in the description of the subject-matter of the contract the criteria used to assess equivalence. 9. In situations where the Contracting Authority describes the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the PPL Act, allows solutions equivalent to those described.
