… which it is permissible to indicate exemplary trademarks. Names provided by the ordering party, if any (trademarks, e.g.: WINIARY, PUDLISZKI) of the ordered assortment are illustrative, and their indication is aimed at determining the expected standard of the ordered assortment, while the contracting authority allows the submission of equivalent offers. The contractor has the right to propose another product provided that it is not inferior in quality to the product indicated by the contracting authority in the product and quantity specification: the quality, taste and weight of the equivalent product shall not be less than that indicated on the form. In the case of an equivalent product, the contractor must confirm the equivalence of the product in question, must indicate on the product and quantity specification form the name of the equivalent product offered, the manufacturer and attach to the tender a document (description, catalogue) confirming that the product offered is not inferior to the product required in terms of the parameters indicated by the contracting authority. In order to enable the contracting authority to check the quality of the equivalent products offered, it is recommended to indicate on the attached document the item number of the price form, which is also the product and quantity specification. 7. The contractor undertakes to perform the subject of the contract in accordance with all the requirements of the contracting authority indicated in the FTZ. 8. The Contractor shall deliver food products which comply with the provisions of the Food and Nutrition Safety Act of 25 August 2006 and its implementing acts. 9. The Contractor shall deliver the foodstuffs by means of transport complying with the legal requirements. 10. The Customer reserves the right to purchase fewer products. 11. During the performance of the contract, the contracting authority may make quantitative transfers between individual items of the assortment within the limits of the value of the contract concluded.
