… the performance of the contract. The subject-matter of the contract is to be carried out on the basis of tender documentation, design documentation and the drafting of works. If the Contractor finds that the above-mentioned documentation contains errors or deficiencies, he should immediately notify the Ordering Party of this fact. 6. The required warranty period for the subject of the contract is a minimum of 3 years (in words: three years), counting from the date of signing by the Employer, the Investor's Supervision Inspector (if established) and the Contractor of the faultless final acceptance protocol for works, with the exception of guarantees for equipment for which manufacturers' factory guarantees apply, which should be at least 2 years. Guarantees for devices granted by the manufacturer will be counted from the date signed by the Ordering Party, the Investor's Supervision Inspector (if it is established and the Contractor of the faultless final acceptance protocol of the works. 7. The Contracting Authority requires the Contractor or subcontractor to be employed on the basis of an employment contract within the meaning of the Labour Code of 26 June 1974 for the performance of the contract of persons performing activities falling within the so-called direct costs. Thus, this requirement applies to persons who perform activities directly related to the performance of works, i.e. so-called manual workers. The requirement does not apply, inter alia, to persons: construction managers, robots, geodetic service providers, suppliers of building materials. 8. Where a trade mark (brand), manufacturer, supplier, patent, origin, source or specific process which characterises the products or services provided by a specific Contractor or where standards, European technical assessments, common technical specifications or other references referred to in Article 101(1)(2) or Article 101(1)(2) have been indicated in the construction and execution design, technical specifications for the execution and acceptance of works, the bill of quantities of works shall be included in the bill of quantities. 3 of the Act, the Employer in accordance with Art. 5 of the Act allows the submission of an equivalent offer or in accordance with Art. 4 of the Act, offering solutions ‘equivalent’ to those indicated in the documentation, provided that they ensure that the technical parameters are not inferior to those assumed in the documentation and that they are consistent in terms of: 1) dimensions and construction (size, type, physical properties, number of components), 2) functional nature (function identity), 3) material characteristics (type and quality of materials), 4) technical parameters (strength, durability, technical data, hydraulic data, linear characteristics, design), 5) safety parameters of use, 6) emission standards. 9. The Contractor, at each request of the Ordering Party, is obliged to present in relation to the indicated materials safety marks, a declaration of conformity or technical approval or a certificate of conformity with the Polish Standard transposing European standards or an equivalent standard or a standard of the Member States of the European Economic Area transposing this standard or an equivalent or Polish Standard or equivalent in the absence of the Polish Standard transposing the standard
